We're not at the 3 year mark. My wife's 2 yr GC would've expired in December of this year, so that's the 2 year mark. That's why we just applied for the 10 yr GC. But, yes, in one year, with or without the 10 yr GC being received, she will be eligible to apply for Naturalization. So I guess maybe 11-12 months from now or so.

But I remember from my process they need a photocopy of the permanent resident card. Are you going to send them expired one's copy? Are you sure about it? Do you have anything such as article or something you read from, or you think it's ok? Because otherwise it will mislead the people who is in the same situation like me and you. I know being 3 years married with US citizen is one of eligibility criteria but I think you need to proof that they accepted your marriage before applying citizenship.

Yes! and you have to wait for almost a year or even worse more than a year to get the approval.

You can use the extension letter, expired green card or I-551 stamp to send in your application for naturalization, they will accept that because they knew your i-751 is still pending, no one will stop you in sending application as long as your eligible, beside its not your fault why your i-751 is pending, point being is that if your eligible then you have the rights to apply.

I wasn't asking the approval. I remember from my I-485, right after I did my biometrics, my status changed from "case was received" to "biometrics was received" or something like that. Now it's been more than a week since I did my biometrics, but my case status is still "case was received".

During the process of my AOS I never had the status of biometrics was received. my status changed from case was received to approval then card production.

I'm not exactly sure, but mine was changed something to about biometrics, and then to RFE during my AOS. I may be wrong though. Good luck to everyone waiting.

Try to access your case online just to be sure. You can see the history of your I-485 online.

Just like Lemon said, as long as you're in the eligibility window, you can apply for Naturalization with a pending I-751. I've read right here on VJ about countless people who've done so. I have no intention of misleading people. See my rep? That's because I don't say stuff without researching 1st.

You're right, my bad. Sorry. It changed from "case was received" to RFE directly. Nothing says about biometrics.

i751- WAC# and CRI89-WAC# the latter works  

I had an account and was able to log in and can add new case# and see history of previous cases.  create e-mail/mobile alerts and get notified when status changes.

You can absolutely apply for naturalization 90 days before your 3rd year mark with a "pending" I-751.  However, an application for naturalization may not be approved if there is a pending petition for removal of conditions. If an applicant’s petition to remove conditions is pending at the time of filing or is filed prior to the interview, USCIS will adjudicate the petition to remove conditions prior to or concurrently with the adjudication of the naturalization application.

 

Basically it may force their hand to deal with your I-751 if they have not already to get your N-400 rolling.

My Husband completed his biometrics this morning. He did an early walk-in at the Dallas North ASC. He said they were friendly and didn't mind him coming in earlier than scheduled.
