Hello There,

 

I have a question, I am a USC citizen filing 2 separate i130 for my mother and father (but will be mailing them together in 1 package . I needed some clarifications on the question - Information about beneficiary's family. 

 

Background information - My mom and dad were married only once and still in the same marriage, they have 2 kids, me (USC over 21) and another boy (over 21 - not intended to immigrate him)

 

On the question Information about Beneficiary's family - 25a and over, who all do I have to list.

 

Ques 1 - Since i'm filing 2 separate i130 for mom and another for dad - Do I list spouses separately on their individual i130s (eg mom as spouse on dad's i130, and dad as spouse on mom's i130)

Ques 2 - Do I have to list down my name on the Information about the beneficiary's spouse and children (I am already a USC and Petioner)

Ques 3 - Do i have to list my bother (over 21, and does not wants to immigrate to US) on this section

Ques 4 - I believe my wife and kids are out of topic of this discussion but confirming just in case.

Hello my friend, these are the short answers: 

 

1. Yes.

2. Yes.

3. Yes.

4. N/A (not applicable).

 

Because of the type of questions you are asking I have a feeling you might encounter a lot of problems filling out the forms, there is always the option to pay somebody more knowledgeable to do the process for you, if not, then read each question very careful and answer what you are being asked for. I will elaborate on each answer:

1. On your dad's form for example it ask about current and previous marriages, when asked you have to input his current wife information and past if any. Same applies on your mom's i-130.

2. Again, you have to input his/her current spouse and children, so input his/her spouse and children (Even if they are not your siblings, this might happen if you are petitioning a stepfather for example).
3. Regardless of your brother's intention or yours, he is their son, so input his/her children information.
4. Did the form ask about their grandkids or daughters in law? No and no, so no.

Simple, do, write and fill what you are being asked for, nothing less nothing more. If they are interested in extra information, then they will ask for it after they receive the forms. Make no mistakes or your application could be delayed or denied.
