Getting ready to file K1 for Jamaican Citizen. Any helpful advice?

My boyfriend is in Jamaica and I'm in Florida. We decided to do the K1 visa. I am putting the packet together. Does anyone have any helpful hints? I have also read a lot about the medical exam and it seems if you say you never have smoked weed and you have you can get denied or you say you have you can be denied? What's the best way to deal with that?

As for the medical exam aspect (or anywhere else where asked with immigration), the only legal answer is to be truthful. You don't need to volunteer any information, but you must answer honestly.

If you answer yes you have smoked you will face a ban. If you say no then your drug test better be clean. I'm going through same issue.

Provide a lot of information about your relationship.  Write a statement of how u met and established a relationship up till the time u got engaged.  Provide pictures, copies of boarding passes, hotel receipts, purchases from airport.  

 

Doctors are not idiots.  Anyone who smokes exhibits certain physical signs.  Someone can say no I dont smoke, the doctor can look at them and tell that they are lying.

From what I understand yes. There are others on here who have gone thru this. I'm just starting myself. From what I hv read and my attorney said it is usually a one year ban.

It's not a statutory 1 year ban. It's at the discretion of the CO, and isn't truly a "ban"...they just won't approve you until you show you are clean for a year. See 2 recent examples below:

Well my fiancé has smoked in the past. So he will have to say that . Very disappointing to know that we are looking at another year.

So I guess we should just get married in Jamaica and file the spousal visa.  I think we would have better chances that way.

The K1 is basically a faster route to be together.  Then once you are together and married you have to file for adjustment of status.  If we get married and file then are paperwork is for the green card and if we get banned for a year then when is lifted we begin the process again.  The odds are better because we are already married.  They might view a married couple differently than a fiance.  Its also cheaper than the K1.

Yes, K-1 is faster & cheaper while a CR-1 is better in every other way (no AOS, no wait to work/travel, etc.). In terms of an approval, they look at the same circumstances and same types of relationship evidence to make a decision about the legitimacy of the relationship (being a fiancee or spouse doesn't change this component).

 

But yes, I would suggest a CR-1 as well if you're willing to wait a few extra months. In the event there is a 1 year ban, the extra few months is small relative to the entire process.
