Forgot check with I-751. Very close to Deadline

Hi all,

 

I have just noticed I forgot to include the check in the I-751 package I sent to USCIS. My deadline is on Monday September 4, so there is not enough time for me to wait for USCIS to reject the package and resubmit, which would be the normal course of action. Obviously I should have filed earlier, but nothing I can do about that now.

 

I spoke to a very helpful representative at the USCIS customer service line. He advised not sending a check separately, as VSC would likely reject this. Instead I should wait for a response from VSC. They would likely either:

1. reject the package, in which case I would have to file again requesting to be excused from late filing
2. OR acknowledge receipt of the package, and send a request for the missing payment

 

I think I will probably be fine, but I'm still worried that they could reject my application, then not accept my excuse for late filing. I wanted to start this thread to ask if anyone else has been in a similar situation recently, and if so what happened?

 

Will update here once I hear from VSC in case this is helpful to others in future.

Every similar story I've heard suggests that they will send your whole package back to you immediately upon discovering that you didn't send a check. That's what happens even if people send a check but it's for the wrong amount (happened a bit after the rate change in December) or if they have trouble reading it.

 

I'd be tempted to make another copy of everything, put in the check, and send that package before Monday. The overwhelming likelihood is that they will return your first package, so this would be the best way to guarantee that it will arrive by the deadline.

If I was in that situation, I would wait for it to be returned, then when you resubmit it (with the cheque this time) enclose a copy of the rejection letter you got, with a cover letter explaining the reasons for it being now a late filing. 

Send it immediately upon receipt, and the quickest possible method.

 

 

I would fear that sending a duplicate may cause their (extremely poor) systems to implode

Yes. I would wait for the package to be returned. Monday is a holiday anyway so sending a new one wouldn’t be worthwhile. 

 

Look at it this way, say you did send a check but forgot to sign or something similar you likely wouldn’t send another filing. 

 

I am sure when you get it back you can send a letter explaining the ‘late filing’ or include the letter you get from USCIS when they return your package to show you did indeed file prior to the deadline.

When our packet was sent in three days before the date our daughters green card had the wrong date on it so my wifes and daughters roc packet got rejected and sent back to us with a blue slip. We resent it with explantion of green card issue and when they received it back they used her date it was originally sent.

 

My wife and daughter had no issue and received their 10 year gc 334 days later. 

 

I would wait and resend it with the check. You should get a blue slip why it was rejected and they will.ask you to resubmit it.

 

I do not think you will have an issue.

I, like the complete idiot I am, have just done exactly the same (I'm absolutely kicking myself!).

 

My GC expires at end of April so I have a fortnight still to submit my application - I'm just wondering, for anyone who has done the same, how long (and I realise that it's never exact) did it take for the cheque-less application to be returned? As I have time should I just re-submit a whole new form complete with cheque (but without original documents that I submitted) or hold tight until the package is returned and submit late with explanation?

 

I know these bases have kind of been covered above, but if anyone has had any more recent experience I'd be super super grateful for any more info! TIA!
