quick question please; do they start counting the 90 days of the form I765 from the day the application is received because if that's the case then my form was received on the 2nd of October hence its almost already 3 months (90 days).

EAD takes up to 90 days or 120, January 2nd will be 90 days you getting close

Hello guys! Does anyone know if I should receive a 797 notice  of action for EAD renewal or is that send only when you apply the first time? And if yes how long it takes after they recieved the renewal application? Thank you

You will receive a receipt notice AND an approval notice. EAD renewal application is a new application. It can tale 1-3 months usually.

HI  SANDRANJ

I HAVE SOME DIFFERENT KIND OF STORY FOR MY CASE. [big snip]

The above was merged into this master VAWA thread.

Please avoid typing in ALL CAPS.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

NOW THE QUESTION IS THAT I NEVER GAVE ANY INTERVIEW FOR I-485 BEFORE THAT AND I NEVER GET GREENCARD ON THAT MARRIAGE BASIS  THEN WHY THEY CONNECTED WRONGLY WITH THAT CASE? IT IS OK ? PL HELP ME AS I HAVE TO PROVE THAT THAT MARRIAGE WAS NOT A SHAM MARRIGE AFTER 16 YEARS.I BOUGHT A HOUSE ALSO HERE .

I NEED HELP FROM EXPERIENCE ATTORNEY ALSO. PL HELP ME EVERYBODY

For VAWA I-360, VSC will check all your previous marriage.  You have to response to the NOIR, providing primary evidence and/or affidavits to prove that your previous marriage at 2000 was a bona fide marriage.

HI  SANDRANJ

I HAVE SOME DIFFERENT KIND OF STORY FOR MY CASE.

AUGUST 2013 I FILED I-360 WITH VERMONT

APRIL 2014 MY PETITION WAS DENIED.ON MAY 09 I FILED NOTICE OF MOTION /APPEAL

FEB 24 2015   I-360 WAS APPROVED .

JAN  2017 I GAVE I-485 INTERVIEW, NOTHING WAS ASKED ,

NO ANSWER TILL NOV 2017 .IN BETWEEN  3 TIME I GOT INFOPASS .NO ANS.FINALLY I SENT REQUEST TO OBDUSMAN

AND NOW NOV 30 2017 I RECEIVED A  NOTICE OF INTENT TO REVOKE MY  APPROVED I-360 CASE.

INTERESTING PART IS NOW :

I CAME USA IN SEP 1999 ON VISITOR VISA,IN JULY 2000(I ALREADY TOOK DIVORCE IN INDIA IN 1998)AND GOT MARRIED WITH US CITIZEN .(I THINK I COVERED UNDER  I-245 LIFE ACT AS IT WAS BEFORE 21 DEC 2000). SHE FILED I-130 FOR ME IN AUGUST 2000.MY STATUS WAS LEGAL AT THAT TIME. SHE WENT TO CALIFORNIA TO MEET HER MOTHER AND SHE NEVER CAME BACK. AFTER INQUIRY I FOUND THAT SHE COMMITTED SOME CRIME THERE SO SHE GOT IMPRISONMENT FOR 5 YEARS. AFTER THAT I GOT I-485 INTERVIEW BUT DUE TO ABSENCE OF MY THEN WIFE MY ATTORNEY SEND A LETTER TO USCIS TO  WAIT FOR COME OUT OF MY WIFE FROM JAIL.

AFTER THAT I CONTINUED TO APPLY FOR WORKPERMIT  AND I WAS GRANTED EVERY TIME. I ALSO APPROVED I-131 ALSO AND IN 2001.I TRAVELED MY COUNTRY ALSO.

IN BETWEEN I MET HER ONE TIME AT OAKLAND AND TOLD HER THAT IF SHE HAS MORE TIME IN PRISON THAN WE GO FOR DIVORCE. BUT SHE TOLD ME TO WAIT FOR ME AS SHE WANTED TO STAY WITH ME AFTER FINISHING HER JAILTIME.I AGREE WITH HER AND CAME BACK TO CHICAGO.AFTER THAT SHE NEVER MEET ME OR SEND ANY MESSAGE .

IN 2012 I MET WITH ANOTHER USCITIZEN LADY(MY RECENT EX-WIFE),WE DECIDED TO GET MARRIED. BUT BEFORE THAT  I HAVE TO TAKE LEGAL DIVORCE IN COURT WITH MY  USCITIZEN EX-WIFE,

SO I GOT LEGAL DIVORCE IN COURT AND AFTER NINE DAYS I GOT MARRIED WITH RECENT EX-WIFE (BETRAYED SPOUSE CASE).

BUT DUE TO PROBLEM FROM HER I FILED I-360AND IT WAS APPROVED AS ABOVE AND INTERVIEW DONE ON THE BASE OF APPROVED I-360.

BUT AFTER 11MONTHS OF INTERVIEW I GOT A NOTICE OF INTENT TO REVOKE IF I DO NOT PROVE THAT MY MARRIAGE IN 2000 WAS NOT A SHAM MARRIAGE.I NEVER GO FOR INTERVIEW AND I PROVIDED  ALL THE TRUE  INFORMATION TO USCIS  IN APPLICATION.AND MY STATUS WAS REMAIN LEGAL THROUGHOUT 16 YEARS.I PAID INCOMETEX REGURLAY FROM 2000 TILL TODAY,

I VISITED TOTAL 3 TIME MY COUNTRY FOR FAMILY EMERGENCY AND CAME BACK.

To understand with if you married twice with USC and got divorced both the times will definitely make uscis think to scrutinize your case more thouroughly as if they left any  clue. Respond to noir with all strong evidences again of abuse from your recent divorce and for your second marriage was bonafide not sham ..proof that what you did to support a life with your wife . If you have an attorney will be good .. see-if Sandranj can take your case would be really lucky ..God is there if you are innocent..

Hi Sandranj,

thanks you for your previous message. You are right my case was transfer from Vermont office to NBC.

I have a quick questions? I don’t understand who it took so long for them to transfer.

Story short:

My vawa as been approuved in 2016 yeahhh but after a year and a half of watting.

on Frebruary 14th 2017 Vermont office received my AOS application and I just receive the notification that it was transfer to NBC on December 4th 2017. Why it take so long to be transfer to NBC?

In a months or two My local office will be almost processing filed that have been send on February 2017.

do you think they will be sending my case on time to local office thay why it can be process on time? I just don’t know how it work :(.

if anyone else know the answer I would like to understand more about processing time and how long it take to transfer from NBC to local office.

How do u calculate ur 90 days?  Coz folks here agree I am past 90 days already

October 2nd to november 2nd=1 month

Nov 2nd to dec 2nd =2months

Dec 2nd to jan 2nd = exactly 3 months

Basically you can't count from october but rather from november

USCIS will not give him any information about your case. Whatever he tells them has no influence on your case. Get a restraining order if he is threatening you.

Also you said you applied in 2015 but it said it was received in January 2017. Did you mean 2017? At this point VAWA petitions from October/November 2016 are being adjudicated.

She sent additional materials to VSC in Jan. 2017. The notice is regarding the communications.
