USCIS takes 90 days  to issue  the EAD.If filed before Sep 7 then you can inquire Uscis.

Got my green card! My process is complete. :D

Has anyone had an experience where a person got remarried after the VAWA I360 approval but before AOS? I am in a similar situation when I got remarried about 2 years after leaving my USC spouse after the VAWA approval. As the USCIS website clearly says that remarriage after the VAWA approval will not affect the validity of petition. If so, can you share your AOS interview experience? What are some of the things that I may be asked in AOS interview. What documents do I need to carry in the AOS interview? Do I need to carry my present marriage certificate?

 

@sandranj : What can I expect in the interview? How can I be prepared? Thanks so much in advance.

There is something wrong with your case, you or your attorney should contact VSC. The friend I helped got her EAD produced on 12/5/2017, and mailed today (12/8/2017). It takes three days from card produced to mailed:

For those with adjustment of status denied you should file a new adjustment of status, because USCIS is not opening all cases denied.

Hello Everyone

 

I have been a silent reader of this forum for a minute and I must say the people on here are very friendly supportive and helpful. I have learned from the experiences of many here and I have decided to share my story and timeline.

 

Filed original i485 with i765  in August of 2016. Had to reschedule interview several times when things got really bad (Verbal, Physical, Emotional and Sexual Abuse). Contacted USCIS to request that i485 be held in Abeyance.

 

My Vawa Timeline

 

Feb 2017 - Filed i360

Feb 2017 - NOA Received

Mar 2017 - Prima Facie Received 

Sep 2017 - Prima Facie extension Received 

Sep 2017 - Applied for EAD renewal (current one expires in Dec)

Sep 2017 - Received 2 NOA's 1. Confirming receipt of i765 app and the other confirming that my biometrics was still good (no need to redo biometrics)

Nov 2017 - Received NOA that i765 app was transferred to Vermont Service Center.

 

This bit of information may be helpful to others with expiring EAD. I contacted USCIS on the 80th day about the status of my EAD given that my EAD and DL would expire soon. I was told that for category C09 there is an automatic extension so basically, the processing within 90 days is no longer stringently followed. He said this is applicable ONLY for timely filed applications before the expiration of the EAD. With that information, I was able to take the expired EAD and the USCIS NOA receipt for the i765 and use that to renew my drivers' license and maintain my employment. 

I know I have a long way to go because I see that there are persons here that are waiting from September 2016, I am hopeful to start law school in January and use that to pass the time until they get to my application. Best of luck to all the everyone here with their petitions.

Hi all,

I posted a few months ago asking for advice. In a nutshell, my US husband turned out to be severely mentally ill with several commitments to mental hospitals as a teenager and young  adult, a fact his family hid from me until we came here. He has been emotionally, verbally, financially and psychologically abusive. He is also a drug user. 911 has been called x3 because he overdosed, he is suicidal,  police has been called twice and he is under the care of a psychiatrist. As a result my two children from my previous marriage are in therapy too because he has been horrible to them. 

 

He brought me here saying he would work and within months he cheated on me repeatedly, stole my money and has quit working after 6 months. As a result I am working 3 jobs while raising 3 children.

 

I went to an organization that helps women like me and they put me in touch with the Immigration lawyers and they said we have a good case to file for ROC under VAWA. I am also in counseling right now. I am trying to create a good credit score so I can move out and rent a place.

 

I am heartbroken, worried and anxious. I have done nothing but support him both in my home country (where we lived for 3 years while I supported him) and here.

All I have done is work and take care of my home and kids. Now we are being kicked out of our home as the house belongs to his father. We have until after the school year ends to find a place to live. He will probably go to adult foster care.

 

I have to file in March for ROC.

I am scared.. I have built a life here. I now have a career, my kids have adjusted, I have friends. (Note we have a common child who is American).

 

I am waiting for a lawyer to pick up my case as they are volunteers. 

Does anyone have any similar experience or personal story to Tell?

 

If it helps, I have all the medical records and diagnoses and the 911 records and his psychiatrist will testify if subpoenaed. So will the kids' doctors.

 

Thank you for all your help. Never in a million years did I think I would be in this position but here I am.

2011 - Met hubby online and became friends
Early 2013 - Confessed our love for each other * Late 2013 - I got pregnant with our daughter
2014 - Our baby was born in Athens, Greece and completed our family. We now have two boys and a girl!! 2013 - 2015 - Looking for jobs in Greece, none were available (due to socioeconomic crisis) 2015 - Decided only way to feed our family was to immigrate and started the process December 2015 - Got married (Greece has a LOT of red tape for foreigners marrying Greeks)
January 2016 - Finished gathering all documents and getting them translated
* * DCF in Athens, Greece * *

28th January 2016 - Finally filed I-130s
29th June - ISSUED!!!!!!1st July - Visa packages and passports delivered to DHL.4th July - Visas in hand! CU in two weeks USA!!
19th July- POE Detroit. All went well!! (excluding our screaming, jet lagged toddler!!)

 

After Arrival in the US

September 2016 - Hubby is diagnosed with congestive heart failure
October - February 2016 - Battle with drug use, overdosing, bringing home a tiny paycheck

March - July 2017 - I am working 80 hr weeks to make ends meet. Discovered hubby's affair. Still overdoses and is hospitalized. Has quit working all together.
July - October 2017 - Marriage counseling. Revealed hubby has "several" mental conditions. Is started on several mental meds.

October 2017 - Got accepted for a college course. Got better job to help raise my kids.

October 2017 - March 2018 - Situation at home is toxic. He files for divorce.

July 2018 - Divorce is final. I have full custody of our daughter.

 

ROC (GC expires July 19th 2018)

July 16th - Package for ROC is delivered to the CA service center (divorce waiver).

August 30th - NOA1 received with 18 month extension (fee waiver approved).

March 28th 2019 - Biometrics

August 8th 2019 - Case Approved No RFE No Interview - 10 year GC in production

N400 (Online - Detroit, MI office)
June 6th 2023 - Applied for naturalization under 5 year rule.
June 7th 2023 - Application received/Biometric will be reused.
June 16th - Interview scheduled.
July 27th - Upcoming interview.



**Our DCF journey to an IV took 5 months and 1 day from turning in the I-130 to getting "Issued"**

Are you planning to divorce?  If so, you can file the ROC with a divorce waiver. 

You did good by seeking help; hope things will get calmer for you and your family.

When I filed for the EAD the first time, I got the receipt 3 weeks later, and 4 wks total  for prima facie. NOAs normally arrive within a month but in many cases it even took 6 weeks so don't worry.
