It doesn't mean your VAWA will be approved because you have Prima Facie . Prima Facie is issued for you to apply for public benefits, nothing else. You can apply for medicaid, some States give food stamps, you need to check in your State.

The work permit doesn’t change your status. You are “pending adjustment of status” if you submitted I-485. As long as you have a pending AOS, they will not remove you (unless you commit a crime of course) but you don’t have legal status either. It’s kind of an in between thing. 

Ok, and if I leave the country with the parole and come back, will I still with the same "pending adjustment of status" right?

You have to go to infopass, and ask your Congress Person to inquire on your behalf.

It is case by case. One lady I helped took a little bit more than 3 months, but another case took less than50 days (EAD was on her hand yesterday):

i have requested renewal , receipt date is October 10, 2017 , I am also waiting for renewal card.

 

i went to my country after 7 years with my EAD card last month, i have stayed there for 3 weeks and when I came back, they just asked me 'how long did I stay? ' and that's it, I re-enter to Usa.

 

Were you out of status while you were here in the US for 7 years before you visited your country?

I have questions. maybe many people also want to know the answers.

 

If my abusive husband contacted uscis to make dishonest statement he's not at fault,  although I submitted evidence of physical and emotional abuse and case approved. will they revoke or delay the I-360 approval?

 

if i-360 case approved finally, how this will affected abusive husband LPR immigration status? can he find out  there's case against him? or have trouble renew PR card?

That seems like a very long time. 

Do you have an attorney? If yes it will be sent there. 

Did you ever change your address? USCIS is very bad about this unless you go to Infopass appointment after changing the address to make sure they changed it. 

If none of the above could be an option, go to an Infopass appointment and ask.

The VAWA unit is trained in what abuse looks like. They know that abusers are often manipulative. They will not consider what he said but what proof you submitted. Also your husband doesn’t have your case number so they wouldn’t even be able to connect the two. 

 

VAWA does not affect the abuser.

My third Prima Facie arrived, and it's only valid for 60 days, Why is it so brief this time?  Does it mean a decision will be made soon?

Timeline: 

May 2016 retained an attorney and started to prepare my VAWA petition. 

11/08/2016 mailed my packet

11/28/2016 USCIS rejected my packet (expired forms) :(((  

11/29/2016 Mailed my packet again Via ExpressMail (I-360, I-485, I-864w, I-765, I-912, G-325A) with previous rejection notice on top & a request to expedite EAD

12/14/2016 Date on the NOA  

12/31/2016 Attorney emailed my Prima Facie (Notice date 12/19/2018)   (180 days)

01/14/2017 Mailed my husband’s birth certificate with the blue receipt that came with my Prima Facie

01/17/2018 I-360 online Update (correspondence received)

12/25/2016 Notice for Biometrics

01/12/2017 Biometrics completed

01/31/2017 EAD update (Ordered my new card)

02/04/2017 My first EAD delivered.

02/06/2017 Picked my EAD & applied for SSN

i have my 3rd prima facie same as yours valid for 60 days,  I'm requesting for 4th prima facie now.

filed early September 2016,  and I received RFE  on 12.5 months after initial filing. responded  RFE on the 14th month.

I hope final decision will made 2-3 months after they got my RFE.

VSC can revoke approved VAWA I-360 anytime if they find fake evidence/documentation were used to support VAWA I-360, but usually this is not initialized by a abusive spouse.

yes my attorney has his address on file . i know the uscis has my correct address because my attorney recieved my biometrics appt letter. also me and my attorney both got my EAD approval in the mail just last week. I guess i will wait a bit more.... my attorney is telling me that recently there has been a delay in EAD and Green Card mailings so its normal.
