I believe this is is one million dollar question.

—There is no straight answer for it.

I’ve been waiting more than 100 days from my receipt and about 30 days after biometrics. I’ve raised SR and reached to my Congressman. Nothing so far. But with God’s help, I know I’ll have my EAD soon.

I guess EAD processing time is case by case.

I helped a lady filed I-765 based on her pending I-485 and her EAD card is being produced in about 1.5 month. She had her biometrics appointment on 11/16/2017.

I do have one serious question,  after reading so many comments on this forum about work permit  ( the c9 and c31) it got me thinking, because my attorney filed mine with c31 which means I have to wait for my i360 to be approved.  My problem is, the wait is killing me and I told my attorney about the difference but she said she didn't make any mistake that the category c31 is right 4 me, but I have been reading and many people are filing c9. Please  what should I do, can I file a new one myself with the category c9 or I should wait after all February case is almost round the corner.  Thanks

Did you file your I-360 on February, 2017? According to the current processing time, you probably will not hear anything until March, 2018. If you file I-765 now, it will take 3-4 months for you to get EAD too.

Yes my attorney did file  i360 together with i485 and i756 but she is saying that bcos it is vawa my category is supposed to be c31. So what I am asking is can I file it myself as she do not want to file it. And thanks 4 ur respond.

Your attorney is supposed to do what's in your best interest. It's not about what she wants or doesn't want. You can ask that she explain to you why C-31 is in your best interest - not just "because it's VAWA", but a more comprehensive reason for why she thinks C-31 over C-9 is in your best interest since both can be applied for if you have submitted I-485. If she is not able to explain a good reason why, then she's supposed to take direction from you on what you want her to do. It's not just what she wants or doesn't want. You are paying her - you should not have to do the work yourself. You may end up filing it on your own, but I think it's more than reasonable to ask her to provide detailed explanation for why she thinks C-31 is the best option for you.

I think you need to contact your congressman. It seems that your case has exceeded processing time.

Contacted Congressman and Ombudsman in Oct 2017. Case was assigned to a case worker in Congressman’s office, I tried following up with them but I last heard was they don’t have any response from USCIS, later the congressman’s case worker stopped picking my calls.

Ombudsman office has not even assigned the case to any case worker yet.
