Hi guys, I've been a lurker...never posted but I figured I could reach out. I first arrived in US in 2010, for undergrad, left in 2014 for work overseas and returned 2015 for grad school. Met my wife in 2015, got married April 2017. My dear wife has turned out to be a nightmare. Started off with revelation that she we couldn't open a bank account together because of some previous credit issues. Ever since she noticed that I found out, she became a different person - threats, calls me at work incessantly, looks through my texts and email, refuses to honor her chores, asks for money that ends up being used on alcohol...bills have been left unpaid and I have had to take care of all that. Now that my OPT is over, my wife has been threatening to call USCIS on me. She's worked as a contractor before for USCIS so I'm super scared. Even worse she started hitting me this summer - a nose bleed from a punch with a lock in her hand, smashed my computer against me, poured hot food on me in an argument. Since she was in possession of all our documents (she was "in charge" of the AOS process), she even tore up my birth certificate after an argument. What do I do? Thing is, I'm a man. I haven't reported her (I'm embarrassed) and I haven't been to hospital. How do I, as a man, walk into a shelter?? I've been thinking of VAWA ever since she made me do ridiculous sex acts for assurance that she'll file for AOS but then went back on her word. It's gone too far. 

 

Here's what I have:

- Marriage Certificate

- Pictures

- Lease

- Pictures of injury (from roommate)

- Affidavit

- Clean background checks from two states

- CRUCIALLY, I don't have her proof of USC since she had all the docs. I only have her SSN from her previous tax returns.

 

Do I have a case? If so, how can I make it stronger, please? How do I overcome not having a medical/police report? I'm worried.

Hi keano, I almost went through same stuff u r going through. Be rest assured u have a case. I didn’t know if VAWA and I was scared of my wife too until a friend gave me a lawyer’ number who told me to call the police the next time she hits me. I told me of VAWA. Soon as she started hitting me, I called the cops. The cops separated us as usual to listen to each side then listened to the neighbors too. They found out my wife always abused me. Hence she was removed from the apartment. I was given paperwork to head to the court where I got an order of protection. 

This is how my VAWA was presented. I hope u comprehend. Goodluck man. U can do this.

I'm sorry you're going through this, you may have a valid case regardless of gender. If you know your spouse's place of birth you may order her birth certificate online. ( https://www.vitalchek.com/ )

 

Here is what I did:

1- I filed for VAWA last year without my husband's birth certificate last year because I didn't know it was required and my passport was expired (you must have a valid ID to order).

2- As soon as my new passport came I ordered it online received the documents in a matter of days.

3- A month later I received a prima facie with a blue receipt (invitation to submit additional docs) so I sent the blue receipt with the birth certificate.

11/28/2016 USCIS rejected my packet (expired forms) :(((  

11/29/2016 Mailed my packet again Via ExpressMail (I-360, I-485, I-864w, I-765, I-912, G-325A) with previous rejection notice on top & a request to expedite EAD

12/14/2016 Date on the NOA  

12/31/2016 Attorney emailed my Prima Facie (Notice date 12/19/2018)   (180 days)

01/14/2017 Mailed my husband’s birth certificate with the blue receipt that came with my Prima Facie

Thanks for this - do you know if it is possible to obtain a consular record of birth abroad (CRBA) from the site as well? I know my wife was born abroad and has a CRBA as opposed to a birth certificate.

I don't know for sure, but it's possible.

And if it's an issue try calling customer service they may guide you or even be able to produce the docs you need.

If you got an RFE to do the medical exam then you have to submit  along with the RFE, you need to see what address they put in the RFE, it can be VSC  or local office asking.
