Notarization is mandatory on affidavits for VAWA petitioners because most VAWA  filers don't have primary  evidences and  the self petitioner  is using the affidavit, which is secondary  evidence, as a primary  evidence. There are hundreds of decisions  from the BOARD OF IMMIGRATION  about it.

 

You got a great immigration officer that   ignored  the  BIA decisions, but  most of them have a different  interpretation  of the Law.

Hi there,  wondering if anyone knows how long is the wait to get the interview once i360 and i485 is transferred?

 

My VAWA Timeline

- Submitted i360, i485 & i765 Aug 10 2016

- Receipt notice date for i360, i485 & i765 Aug 15 2016

- Received Prima Facie Aug 29 2016

- EAD approved Oct 11 2016

- Received new Prima Facie Mar 31 2017

- Receipt notice for EAD renewal July 20 2017

- i360 and i485 transferred November 6 2017

- I765 renewal approved November 7 2017

As I mentioned before many people asked my help after them or their attorneys  screwed  up their cases, and I saw MANY  MANY   RFEs issued by Uscis stating  they did not give ANY weight on  the affidavits  received because the affidavits were not notarized, in part you are right they will not issue and RFE asking to notarize, usually they  say they will not consider  the affidavits received  or they  will deny.

 

Uscis can approve Vawa without considering the affidavits because the immigration  officer  considered  that the primary evidences submitted  were enough, to prove abuse or bonafide marriage,  and then they don't need to look/consider the secondary evidences submitted.

I always thought once they approve a petiton, they don’t look at it again but send it to NBC

 The local  office  doesn't have authority to deny  AOS based on VAWA ,but the local office can ask  VSC for reconsideration  in situations  such as discrepancies, non credible  person,  or discovered a  new fact  that VSC wasn't  aware when adjudicated the  case.VSC can reaffirm  or revoke.

I am confused. VSC approved your case and transferred your I-485 to your field office. How can your field office review your VAWA case in details and sent back to VSC because of discrepancies? I thought filed office would just focus on I-485.

I swear to God I thought same same thing!!! Weird!!! These peeps are damn unpredictable smh!! My attorney currently working on a good response to the NOIR tho..!!

Depends on your local office and their processing time. I've been waiting for 5 months now. My approved i360 and i485 was transferred since June.

I think they may request an RFE if there is something missing in the affidavit or something that needs further explanation. If you sent in affidavits which were not notarized, don't worry too much about it. Fingers crossed that yours will go through like mine and you won't need notarization.

Didn’t notarise my second RFE too but had them handwritten by each individual and signed. Handwriting ofcoz shows they were by different individuals. I got approved.
