Thank you miloy. I have EAD from my I 130 that will expire in January and I'm still waiting to see if the officer will agree to put my I 485 on hold until vawa is adjudicated.. I have the interview in 2 weeks so based on that I'll see if I have to file a new I 765 or just renew the old one. In my situation I guess photos are not required  then?

Not sure if you are asking about photos for I-360 (your previous post) or photos for EAD renewal.

 

For any EAD renewal, two passport-style photos are required. They will not use your photos on file, instead, if no photos included in your EAD renewal application, you will receive a RFE, which will delay your application for 1-2 months.

 

For I-360, only if you request an EAD (C31) based on the approval of I-360.

@sandranj    Thank you.Today something weird happened .some one called from USCIS saying that they are cancelling my interview date and they are going to reschedule my interview after a month without giving any reasons.Should I be worried?is this normal?what can I do to keep my old appointment?I did not receive any official letter from them even online does not say anything.

That sounds strange. What does your online status say? Did you already receive your interview notice?

my online status is the same.I heard horrible stories that people received cancellation letters then they did not show up for interview and their application was denied.I do not know what to do?????????????

so that means, when you file new 360 application, and you check for employment authorization, also include 2pics

then you dont need to file 765, please confirm thanks

Correct but the EAD (C31) will only be approved after the approval of the I-360. So this is an option for LPR spouses, or USC spouses who decide not to file I-485/I-765 while I-360 is pending.

If you are eligible to file I-485 and I-765 (C9), you will get EAD while the I-360 is pending. The I-765 (C9) is based on the pending I-485, not I-360.

If you like, you can check the employment authorization on I-360 and also file I-485/I-765 if applicable.

if as USC spouse i am filing 360, without 485, same time i am checking employment authorization

submitting 2pics, so still i am not getting EAD, till i approve 360, just as advise by other member , i am not filing 360 with

485

Correct. The only way you are authorized to work is if you have a pending I-485. Otherwise you have to wait for I-360 to be approved first before I-765 can be approved.

Can someone advice i had asked for decree from my home country court and also my first husband but he said as its 17 years old so they tried for month to look for it but were not able to find as its not like US that they keep recoed of everything..so he can give an affidavit that he got divorced and got 2 martiage will that work? divorce gappened in 2001 .

also i got psychological eva from Lmft but doctor is Phd will that help for my .Rfe also got dome pics of abuse and foctor report that he pushed my son so he got a hairline fracture and gad developed tumor so getting his surgery 

Will these docs work to satisfy rfe.

thanks in advance for any advice

so, when was the current version released? I marked c31 and i did not submit 2 photos yet. do you think the rfe require the photo as well?

The version of I-360 with the check box, marked as 3/14/16 N was release on the 2nd half of 2016. The current version, marked as 12/23/16 N was released early this year.

 

I am not sure how USCIS will process your EAD request.
