 You wrote " I fled to my Country now..."  then  I understood that you are living abroad.

 

You can get the evaluation done here.You should attend therapy where you live(5/7 therapy sessions), just an evaluation done will not help your case.

 

Did you mention to the doctor  that your husband pushed and you fell down? if you have a  copy of you  hospital history stating that you fell down due to domestic violence  then you won't need a psychological evaluation.Do you have any police report about the abuse?

Contact your Congress Person to inquire on your behalf because USCIS is  adjudicating Vawa cases filed in October 2016, despite I still have some cases filed in September 2016  still waiting adjudication.

Thx for replying Sandra .... i have talked to doctor here and told her about my past surgery and then this pain cause of again pushing by my husband as i guess now again the same vertebrae is pressing my nerve due to falling.. If my doctor asks for MRI then i have to go for it. I dont have hospital record as I didn't had any idea at that time no medical just over the counter pain killers have been taking since then now i have medical so getting treatment . Have been sick since then .

Hello there,

I got a question, prior to applying for vawa, I had submitted my EAD renewal because I had EAD when my ex filed for me, now nothing had happened, until today I got a mail saying that my case has been transferred to a different office and they are working on it, I submitted my i360 in June and so far I only got the receipt nothing else. What does that mean, are they putting the EAD on hold until vawa is approved?

Did your ex withdraw his affidavit of support from your old petition? If yes, then your EAD filed with that petition becomes invalid. 

 

If you filed I-485 with your I-360, then you can file I-765 (EAD) under category C9 and you will get it within approx. 90 days. 

 

If you only filed I-360, then you have to file I-765 under category C31 and your VAWA needs to be approved before they can issue you EAD, which means though you won't be able to work for like 10 months.

Was just checking my divorce case in the case status system aaaand... judgment entered!

 

YAAAAY!

 

Feels great knowing that, even if my VAWA gets denied for whatever reason, I can pack and leave without being attached to him anymore.

There are fee waivers, check your local superior court's website for the information. I didn't have to pay anything but I filed before I had EAD, so it was easy to prove that I had no income.

Divorces are a matter of state law, and within state, the time it takes to get it finalized varies depending on the workload at the specific courthouse that has jurisdiction over your suit and also on the complexity of your particular case.

 

I filed at the Los Angeles County Stanley Mosk Courthouse (California). It took me about 4 months to get it finalized, but the other party defaulted (failed to respond to the case), so it helped. There are many specifics that you need to research in order to know what to do, but it's doable. I was self-represented and was able to finish it. This is one of the rare occasions where not having EAD actually helps you: a lot of time to do research and attend lectures at the local self-help center.

 

Per CA law, my marriage won't be over until November, because there's a mandatory waiting period of 6 months counting from the date of service. But I'm extremely happy knowing it is now certain.

 

I got a fee waiver. Here in CA there's a form you use to request it, and with zero income it's certain to be granted. Since you're in MD, I can't give you specifics as I'm not an attorney and my experience is limited to my own case in CA. But rest assured it is possible! The key is methodical research and preparation. Check your local courthouse to see if they have a self-help center. In LA, they have workshops that teach you how the process works and also a lot of information on their website. It's a matter of putting time and effort. Also, the more involved you think the other party will be in the case, riskier it becomes to you, as you have to know all the maneuvers in a contested proceeding. I was lucky that he missed the deadline to file a response and I went to the courthouse the next morning, with my Request to Enter Default in hands. If the other party gets involved, it will be of tremendous help at least to get a few consultations with attorneys. NGOs offer legal assistance both to victims of domestic violence and self-represented parties who can't afford lawyers. Do some googling and see what is available around you. Never give up!

Yes! Very true! This is what I did, I got a fee waiver! :)

Lucky you. 4 months is not bad! Did you file a fault or no fault divorce? I know I may not qualify for the waiver because I have a job and receive income

Yeah, very lucky! I'm so happy, it's one of the few good news I had recently! All divorces in CA are no-fault. I'd advise you to do research on the fee waiver anyway - each state has it's own qualification criteria, at least take a look to evaluate your options ;)

I have filed September 27,2016 still no updates. i am also checking everyday and losing my patience :(
