iam very comfused about the PD .. you mean if iam married to USC i have faster processing time than LPR ? 

 

I didn't say if someone is married to a U.S Citizen the processing is faster. I said you are not married to a green card holder then you don't have a priority date.

Now matter whether you are married to a USC or Green Card holder, the processing time for I-360 form is the same. The difference is about submission of I-485. You can submit I-485 along with I-360 and get EAD while your I-360 is till pending if you are married to a USC. For people who are married to LPR, they can't submit I-485 ( No EAD either) until their I-360 gets approved. 

 

In all, everyone needs to wait the regular time (10-13 months) to get i-360 adjudicated. 

 

 

 

So how come I was approved in 4.5 months and why was my I-130 PD printed on my vawa approval notice? 

And why have several immigration lawyers said the i-130 priority date is transferable to vawa application? It's also on the internet that it is transferable. 

Im extremely curious. I don't want to believe I'm just extremely lucky 🤷🏻‍♀️

what else you applied with 360, or just alone i-360, no 485

I applied for i485 and work permit in December 2016 via marriage. Got work permit since may. Just waiting for my i485 interview to be scheduled now ... that's all

so your spouse is USC or GC holder, and did you also clear you I-130 interview too, 

my I-130 interview was in last Aug, my spouse didn't want my status, + all abuse, so  last month i file me

360, my spouse is USC, so please tell my about your I-130, did you proceed

My estranged spouse is USC, never had I-130 interview. It was approved in 2015. I had the I-130 in my possession when we parted ways, was able to submit a copy with my i360

Dear iam so happy for you .. you’re very lucky i hope you have your interview very soon ❤️

Iam in the same boat like you asking about the PD some people say i will never have a PD because iam married to usc .. but i have read this on the uscis that i can transfer my pd of the i130 to the i360 .. that’s why iam very confused ! 

Did you attach a copy of your i130 along with the i360 application ? And any requestes to use the priority date for the i130 ?

Thanks dear. Yea I attached a copy of my I-130 when I submitted my i360. On my vawa approval notice, my I-130 PD date was noted on the top right corner of my notice. I never requested for the PD to be transferred, maybe it's up to the officer adjudicating the case or maybe it's a rule we are not yet familiar with 🤷🏻‍♀️ I don't see any other reason why he will leave hundreds of petitions pending before mine and since 2016 and adjudicate mine before theirs. There's no other logical explanation

AOS adjudication  can take four months, It depends of the workload of each immigracion  officer, most of them take 6 months, others  less. 

 

There are thousands  of incompetent lawyers, even some   famous attorneys sometimes post wrong information. Just last year i fixed over 30  mistakes that some attorneys made in VAWA /AOS cases. Every year  hundreds of attorneys  are disbarred, some for years others for life because of serious errors made in their  client's  petitions. 

 

The person can transfer the priority  date established for the l130 to the  l360 if the  person  is waiting  for a visa number( spouse of GC holder.) Sometimes the priority  date is available   before the date we expect to be current,  and sometimes  there is visa backlog. 

 

USCIS by mistake  many times put the PD on receipts of U.S Citizen's spouses. USCIS  makes mistake as well. Last year they issued a 2 year GC for AOS based in abuse,sometimes they send messages saying the  person address was adapted when in reality  the person didn't update the address.

 

This  year one immigration officer  said to one of the Vawa filers when attending  his AOS interview that he couldn't approve the GC because  the self petitioner was a crew member.The petitioner  asked the presence of theUSCIS  supervisor, and the supervisor   came to the room and told to the officer that the  crew member role does not apply  to VAWA petitioners,  as you see attorneys and Immigration  officers  often make mistakes  and give wrong information as well.
