Thank you very much for your response, I don’t know why it didn’t occur to me to go to an office. There’s none in the city I am but I sure will travel to it. I guess the line i. Called was the wrong line then...thank you again. This is the number I’ve been calling ‭(800) 829-1040‬😏

@sandranj have interview for naturalization based on VAWA.I am so nervous for my interview based on VAWA.it is coming in 2 weeks in chicago office.I submitted my application after 3 years only.Can somebody share what happened in similar interview?do they ask about VAWA case?Do they question the abuse?will they ask about the bona fida of marriage?What happens in this test beside civics and English test?what questions they ask?

Hi folks .. 

Iam new here and i really need your support and advices .. iam married to a us citizen now for 7 months and we applied togeather for the AOS 6 months ago but he started to abuse me after we filed the papers .. and was threatening me all the time to call the police to deport me if i didn’t give him money .. and when i refused to give him momey he started to abuse me physically and emotionally many times .. i went to the hospital once and i have reports from the hospital reporting the abuse and the social worker reports too .. but i didn’t go to the hospital after that because i don’t have insurance and they send me a bill for that time 2000$ which i cannot afford .. moreover i didn’t call the cops for him because iam always afraid of him to harm me .. iam now gathering all the documents to file as a self petitioner .. my question is can i transfer my i130 PD to i360 ? Please help me i have no experiences in this matter :(

Hey I think that should be the lease if your concerns.

 

having been through domestic violence and filed for vawa I encourage you to do the following:

 

1. Take notes of incidents in details with date and time.

 

2. Plan an escape from the abuser

 

3. Gather information and documents you’ll need to file for vawa (copy his birth certificate, passport information page, ID, Social Security Card, marriage certificate, pics of medications if he takes any, tax papers and anything to prove you entered into a real marriage.

 

4. Seek shelter or help to escape 

 

5. Get records from hospital and police re physical abuse you suffered 

 

6. Emotional/psychological abuse you should consult a therapist and get an evaluation after 5-7 sessions

 

7. Prepare I360 or seek help in filling out the forms and attached evidence. I suggest you file a new i485 with I765 and I131 file for a fee waiver if you can’t afford. You’ll need to prove financial hardship submit pay stubs or bank statement.

 

8. Depending on what state you live in Medicaid can pay your outstanding medical bills

 

Dont be discouraged to file vawa because of the lengthy wait time and process. Your life is valued more than to get a green card in the shortest time.

I’m not sure about the wait time because I have a PD of Dec 7, 2015 and I been waiting for over a year now since I filed vawa. Yes once you file I485 you can get work authorization and advance parole. I been using my advanced parole for a while now with no issues.

 

my only advice is don’t let the wait time be a deterrent if you’re really suffering from domestic violence and want to be free. The Law is not a shackle and you can set yourself free!

THank you so much dear you gave me hope because i want to travel to see my mother she’s really sick :( .. i heard before that i cannot travel while i360 pending .. Iam glad to hear that !

Yes, one can apply the PD in one's I-130 to I-360 for green card spouse. Since your spouse is a USC, you do not need that.  For VAWA I-360 to be approved, in addition to the abuse, you also need affidavits and evidence to prove your initial marriage intention/bona fide marriage and good moral character.

If your husband is a U.S you don't have a priority  date, if he is a GREEN card holder then yes you can transfer  the PD.

 

If you have a copy of the  hospital record then you  will be fine to  prove abuse.

They can ask question about bonafide marriage,but they  won't  ask about abuse

Just  saw now  you have a pending  AOS  then there is no PD to transfer.

I would not go to a psychiatrist, their psychological  evaluations are not good for VAWA  purposes because they just performed  tests and prescribe medication,  they don't mention the abuse with details.In 15 years I never saw one single good evaluation  done by a psychiatrist.  Find a psychologist  or a counselor  with specialization  in  domestic violence.

After having my i-360 approved BUT no interviewed yet.

I have a question: Do I have to prove (again) anything to the immigration on my interview, like bonafide marriage? 

I’m asking because I’m still having some bills on my ex-jerk-husband’s name and I really would like to switch all to my name, but I’m hesitate about having to prove at the interview.
