i just filed my WAVA on 10/05, after my spouse refuse to go for I-130 interview (long story), my spouse is USC,

No expedition in VAWA at all, you’d have to wait as long as it takes; 9 to 12 months or more unfortunately. It’s a patient game so be patient and persevere

1) Does it make any difference who files for divorce in a VAWA case? (My husband has been holding on to signed divorce papers, as a gambling and control tool for more than a month). I'm wondering if I should go ahead and file myself. 

2) if I file, do I have to list abuse as reason for dissolution of marriage? It is. I just need to know if that helps my case. 

3) do you know of any domestic violence centers or legal places that can help me with my VAWA case? I've contacted Catholic charities, they set me up with a free one hour session with attorney appointment next month very far from me. I went to 3 other places so far and two of them no longer exist. One referred me to the above.

1. My ex filed for divorce but she didn’t conclude the process. I had no money to file so we r only separated and not legally.

2. U can file for divorce based on whatever ur reasons are; irreconcilable differences etc that well up to u.

3. Catholic charities are better but then again u can do it ur self, it really isn’t difficult if u follow instructions and ask for information on this platform and also consult Sandra. I practically did my VAWA on my own and after it got approved I filed for I485, I765 etc on my own with the help and f Sandra of course

My advice to folks here is: if u have a good VAWA case, consult Sandra. She might get frustrated with u if u r not catching up quickly on what she’s explaining to u but be patient and keep asking till u understand. No matter what, I assure u u will find success. Sandra got frustrated with me often lol but I never let her go even when she said she wasn’t reviewing my case no more I still kept sending her my case. And she worked on each and every one of my RFE. Remember the story in the bible where a man hel on to the angels garment n didn’t let go till the angel gave him his wishes? Exactly, hold on to Sandra. She’s ur angel

@bold thank you for your advice. It gives me hope. Today's my first off day since I received the denial. I'm going to get started with the forms. I've been compiling evidence before and after work and during the night in The meantime. 

I appreciate this website. Everyone is so helpful and generous.

If he didn't attend individual  therapy for at least one year and anger management  classes for at least 6 months  then don't continue living with him because the abuse will continue. Abusers don't stop abusing their victims just because they decided "ok I dont want to abuse her anymore". The abuser has the moral compass broken,  lack empathy  towards others. They don't have a "mental illness " as many victims describe their abusers. Abuse is a choice, it's about power and control.

 

If you don't have a place to go then go to a shelter for victims  of domestic  violence.

 

VAWA  was enacted for victims fleeing domestic  violence and not as a escape to get a green card.

As per my divorce, that is not a priority right now.

U better. It’s a long process so be ready and don’t ever think u can’t do it. Successful people didn’t get there by walking the smoothest of paths.....there will always be obstacles and each must be overcome. Take care now

 I get frustrated  sometimes. I have hundreds of cases to review.  I have my job, my family. I don't have enough time  to help everyone and sometimes I have to ask  100 questions because the person doesn't  tell me the whole story and I need to keep asking and asking.I will not help someone if i am not convinced 100% the person has a vawa case and entered into marriage in good faith. You  won't believe how many scammers I met here and asked my help.

Unfortunately, there haven't been any November 2016 approvals yet on this forum. Ms. Sandra might have some November cases approved already, but not on this forum. As far as I remember, there is only one September filer who got approved this month, the rest of the September filers are still waiting. None of the October approvals were heard either.
