Do you know if you can still use your I-130 approval receipt *if it has expired? Meaning, my date has passed and already divorced :(

Hello everyone please I need your quick input. I left my children with my ex husband because I have no where to stay and don’t have a job to even provide for them. Long story short, I have the kids birth certificates and such. I left copies for him. 

**He keeps leaving messages and voicemails for me that he needs my daughter’s green card. My question is am I going to ever need her green card for anything? 

My concern is I don’t know if I’ll ever need it, because if I do, there’s no way I can have it back, once I mail it to him. Thanks

Sandra my work permit expires in January and I know it takes about 3 months to get the renewal. Would you advice me to wait and send the i 765 renewal with my vawa petition to vermont( i'm still working on psychological) or its okay to send it now based on my pending 485 with the spouse? i have the i 130 interview in 3 weeks and ill request to put AOS on hold but if they deny that i guess my work permit if i submit now is going to be invalid?.. Hi guys. Husband withdrew i864. As a result, my aos / i485 application was denied. In the denial letter, I was told my EAD is revoked. I'm planning on filing VAWA. is there anyway of getting an EAD with advance parole while Vawa application is processed as I'd really like to see my family. It's bn so long. I was waiting dlfor the green card. Which took a yr but husband wrotr the withdrawal letter 11 months after out green card application. 

I'm so devastated! Husband keeps saying we should refile but I'd rather not go through that again as it's been a very depressing marriage and refiling only means being exposed to his abuse for at least another year. I think it's best I call it a day with this marriage. I tried my best. 

 

I feel so betrayed.

What kind of RFE they have requested?   In 11 months they issued 3 RFE?

No she just meant that there are two moments when you can receive RFE. First when they initially receive/review your petition for completion and then when they actually adjudicate your petition. At that moment you will either get approved or get an RFE. You won’t know until you get it.

If your spouse or ex-spouse is an USC, you can submit I-360, I-485 and I-765 concurrently to get EAD in about 3 months. However, for the VAWA I-360 to be approved, you should be able to provide evidence, and/or affidavits for your initial marriage intention, bonafide marriage, being abused and your good moral character. You should consult a VAWA expert.

Thanks for your reply. Gosh! I guess I have to spend the same about of money applying for this as I did exactly a year ago. 

Husband says he will take back what he said in the letter. Does anyone know if he can do that? We're hopig that'll let uscis proceed with processing our initial 485 application. 

Failing which, I'd have to file the 485 all over again and hope for the best.

Don"t make a mistake to refile with him;

otherway it is going to be a cercle of domestic violent again.

What does he need the original greencard for?? Im trying to think and I cant come up with any reason.... A copy of the card should be sufficient for most things, but its concerning that he would even need that. Is he applying for something on the childs behalf? Personally I would find out what its needed for before doing anything. If its a reasonable request, he can have a copy or you can send the copy directly to whomever/whatever it is its needed for. For example if its health insurance related you can send a copy to the employer or health ins company directly.
