In the last month, I saw a few posts on here about background checks from home countries. I am curious why a few different people are doing this. Is this something you have to do if you have felony records or from certain countries, or something? Or is it only if you get an RFE for a home country background check?

It depends on how long you have been in the US, you have to provide police checks from all places you've lived in the last 3years I think. I have lived in the US for 10 years so I did not have to get a police clearance from my home country

Hello everyone. Did anybody here send a letter to USCIS local office to hold i485 in abeyence after recieving the interview appointment? I dont know if its better to send the letter or to just go by myself and request that there? i also dont have the vawa reciept notice yet since i'm still working to put all documents together. thank you all

Another question: The 90 days to expect the WP+parole starts when?? With the receipt date?

First, the VSC checks if the police clearance is missing and then issue an RFE,  but later on (6/9months) they can issue a  new RFE if you didn't submit enough proof of abuse and/or bonafide marriage.

Don’t send a letter. Go for your interview when it’s scheduled and ask the immigration officer to put your i-485 application on hold because you’re going to file VAWA soon. 

I filed VAWA after my marriage based I-485 interview and I did the same as written above.

You will get a notice to do your biometrics with your appointment date, time, place and instructions on it, via mail. Just read it carefully and follow it. 

EAD filed with form I-485 under c(9) category usually arrives between 1-3 months after biometrics. It all depends on how quick it gets processed.

Thank you redmango. I'm just worried because I read here that some officers agree to do that, some don't especially if you don't have the vawa reciept that proves you filed already.  Was the officer pretty understanding about the situation? Did you have your lawyer with you? Thank you again

The immigration officer was pretty understanding. I asked to put my i485 on hold while I gather documents to file VAWA petition. Even if for some reason they cancel/deny your marriage based i485, you won’t get deported if you file for VAWA soon after the i485 interview. Pending vawa means everything is on hold.

You must  provide police clerances  from all places that you lived in the past 3 years.

YOU should attend the interview and ask the  IO to put your I-485on hold until final adjudication of your VAWA.

If the officer decides not to hold your AOS and deny your case  then just file a new AOS.
