Having children will help to prove a bonafide marriage in your  case,, but keep in mind   Uscis  will consider your  intent when entering  into  marriage. For example many  women date 2/3 months become pregnant and get married, in a case like this is very difficult to prove a bonafide  marriage  even having  one,two  children. The children prove  they  had sex, but  the criteria used to consider a bonafide  marriage is not just  having  a child, it's the  intent as I mentioned above,  commingling  finances  etc....Many VAWA filers  don't  commingle finances then the person has to explain why not. 

 To have a  VAWA approved you  need to prove a bonafide marriage and abuse. To prove abuse you need a police report,or other  documents  such as a  shelter letter, hospital  history  showing you  were abused, a valid  restraining order,  or a GREAT psychological evaluation showing you have depression  and/or post traumatic  disorder due to the abuse suffered.

I added at least 5 witness letters from friends and a counselor I had seen. I also added an evaluation letter from my therapist with a CPTSD as the diagnosis.

i never filed a police report because I was scared. I added about 6 pages of my narration of the abuse over the years. The abuse was mostly financial, emotional, psychological and such. He had actually filed for me but due to the emotional trauma I was going through and the fact that it got so bad I was suffocating, I had to get out to save my own sanity. I felt like he was holding it over my head, and couldn’t live with it. By the time I finally got an interview date, I was already divorced so couldn’t go.

Yes, it said that, but I just got a notice to say they sent an RFE letter. I pray yours gets approved without an RFE. This is my first RFE. I filed September 16, 2016.

Hi Peanut Butter, the receipt date on my 3rd prima facie is September 19, Notice date September 23, expiration date November 22.

When did you  file your  VAWA petition? if you filed 1 or 2 months ago probably they  are asking your  police clearance or some doccument  that you forgot to submit, but if you filed over 6 months ago  probably they are requesting  some doccument  to prove a bonafide  marriage andl/or abuse.

Filed for forms I 765, I 485 and I 131 after recent VAWA approval (with Sandra’ professional assistance as usual), well I received notice for fee waived for all three forms. That’s my recent upgrade. So be encouraged guys. Good things take time and perseverance.

Hi @sandranj

i have a question just for my clear grasp about bonafide marriage. You said couples date 2/3 months and the girl becomes pregnant and they got married. What if they choose to marry for the future of the child, is that a bonafide marriage?

USCIS will send you individual receipt notices with different number for each application. Receipts will be in separate envelopes and might arrive in mail on different days.

Hi My  Beloved Sandra! I hope you are doing well. Thank you for taking time to respond to my post. I received the letter today, and it was for background check from my home country. They say the 3 year hadn't come yet when I filed VAWA. I'm going to get right on it! After sending them that- correct information and everything, do you think they will ask for more information?

First, the VSC checks if the police clearance is missing and then issue an RFE,  but later on (6/9months) they can issue a  new RFE if you didn't submit enough proof of abuse and/or bonafide marriage.

09/07/2016 approved I765

09/07/2016 order card.

09/12/2016 l got WAS CARD

02/27/2017 RAE (Request additional evidences ) for I360

05/15/2017 they got response (evidences)

09/07/2017 approved l360

10/04/2017 Case Transferred To Another Office

10/19/2017 Request for initial evidence was mailed.

 

l'm waiting letter. it is possible medical or police celearence because both of them were may 2016.
