Do you guys think December filers will hear by the end of this year? Or is it more likely to not hear until next year?

Am December filer and the only thing I heard from from them was an email saying.....

Application Type: I360, PETITION FOR AMERASIAN, WIDOWER, OR SPECIAL IMMIGRANT

Your Case Status: Initial Review

On August 16, 2017, we updated your name for your Form I360, PETITION FOR AMERASIAN, WIDOWER, OR SPECIAL IMMIGRANT, Receipt Number

And beginning of October they extended my prima facie for 180 days.

Take your original birth certificate and respective translation, original marriage certificate, divorce decree ( if you are divorced or if you were divorced before), a valid passport.Take with you the EAD, I saw some cases that the IO asked back the EAD.  It's advised to take all documents showing a bonafide marriage.

I explained here before that VSC is not adjudicating the AOS anymore, the local office is adjudicating now.  If you were arrested or have a restraining order against you then you must have a CERTIFIED COURT TRANSCRIPT.  Arrive 15/30min before the interview.Yes, you can enter using a  backpack, your cell phone should be off ok. Do not handle documents to the IO without asking for permission ok.Good luck.

Dear Sandranj, I feel so lucky that I can get your great reply at such an important moment in my life! Many many thanks and hugs to you:) Keep praying to God!

I would say, about 80% of the cases take 10-12 months to get finalized recently. However, there are about 19% of cases filed around end of June, 2016 are still pending. Cases without I-485 taking longer is just guessing only. You may want to contact your congressman to inquiry your case on behalf of you to figure out possible issues.

Thank you for your insight.

Vawa is taking 9/12 months to be adjudicated, not 2 years. You did not file form I-485 then your EAD will be issued 30/90 days  after  the VAWA is approved.

Thank you Sandra, will you suggest I pull the I-760 and refile with the I-485 to expedite it or I should just wait? Thank you.

I am also a December filer. Did you file early  or late December. I was not given prima facie and I didn't request it. The wait is so long and painful but we just have to be patient 🙏

Filing I-485 will not expedite your VAWA or EAD. It's up to you if you want to file for AOS now or not.  If your VAWA is denied and you don't have a pending AOS  USCIS will not start removing proceedings, but if you have a pending AOS and  your VAWA is denied USCIS will start removing proceedings.

@sandranj would you suggest not applying for an AOS until after VAWA approved?

Good Morning

Good Morning

In my opinion, If the person doesn't have a STRONG VAWA  the person should not file I-485 along with form I-360.
