Last year when I was preparing my case it took 6-8 months then they increased fees in December 2016 as their timeline STRETCHED to 8-9 months

(ex. last update was 343 and not 367 days) let's hope the actual process doesn't get more ridiculous and tormenting!

 

 

Timeline: 

May 2016 retained an attorney and started to prepare my VAWA petition. 

11/08/2016 mailed my packet

11/28/2016 USCIS rejected my packet (expired forms) :(((  

11/29/2016 Mailed my packet again Via ExpressMail (I-360, I-485, I-864w, I-765, I-912, G-325A) with previous rejection notice on top & a request to expedite EAD

12/14/2016 Date on the NOA  

12/31/2016 Attorney emailed my Prima Facie (Notice date 12/19/2018)   (180 days)

01/14/2017 Mailed my husband’s birth certificate with the blue receipt that came with my Prima Facie

01/17/2018 I-360 online Update (correspondence received)

12/25/2016 Notice for Biometrics

01/12/2017 Biometrics completed

01/31/2017 EAD update (Ordered my new card)

02/04/2017 My first EAD delivered.

02/06/2017 Picked my EAD & applied for SSN

02/14/2017 Applied for state ID

02/15/2017 Applied for Medicaid

06/03/2017 Received my Prima Facie (180 days)

10/22/2017 Mailed EAD Renewal  & AP & Waiver (I-765. I-131, I-912) and request to extend PF

11/21/2017 Received my Prima Facie (60 days)

12/13/2017 Received my New EAD/AP combo card

03/08/2018 Received my Prima Facie (60 days)

05/03/2018 Received my 5th Prima Facie (180 days)

07/26/2018 Mailed EAD Renewal  & AP & Waiver (I-765. I-131, I-912)

09/05/2018 update (ِِAfter responding to the senator's inquiry USCIS stated my file was mailed 08/14/2018 and received by NYC field office 08/23/2018) 

9/22/2018 Received my New EAD/AP combo card

10/24/2018  Attorney emailed my interview notice

11/05/2018 Completed the medical (I-693)

So so far no response for 3rd Prima Facie but EAD was approved in 1 month and no RFE. Hopefully I hear something for the 360 soon. 

 

I recieved a fee fee waiver for all application and I sent a very detailed filed to USCIS during the 130 and 1485 stage in December 2015 and I did the same very detailed file in filing 360.

 

i had police reports

restaining orders

court orders

pictures of abuse

arrest records

prosecution official letter stating I was never charged and that my spouse was charged for menacing and physical abuse 

Doctor gave sworn statements 

therapist gave evaluation

i had included previous documents for Bona Fide marriage 

letters from my college lecturers and tutors 

letter from my job 

and letters from friends

Letter from shelter 

 

I wrote a detailed statement From dating, marriage, to when abuse started and when I leave the marriage. 

 

 

all documents submitted are all sworn statements 

 

I’m waiting until December if I don’t get an adjudication by then to contact Congressman for help.

How has your experience been traveling on AP without having VAWA approved. Do they pull you aside and question you? Did you ever feel scared to not be admitted into the US?

It is already the mid Oct, only one case that was filed in September got approved last week and there are still a few September filers waiting for decisions. I see the waiting time increase from 6,7 months, to 9,10 months, and now to 13 months.  Now matter whether they have increased the fee, since we have the new president, all the immigration cases are backlogged.  Let's pray for each other.

No. even if you have approved I-130, you still need to wait the same length of time for the adjudication of I-360 just like others. I-130 only makes your I-485 submission earlier if you are married to a LPR (not a US citizen).

Well once you’re using AP you will be subject to secondary screening. The process is smooth; the CBP rep takes you to the secondary room, you sit and wait for your name to be called and answer any questions truthfully. Then they stamp your passport with a “Parole Since” stamp with arrival date. They asked if I was ever arrested and I respond Yes and he asked what for and I said counter claim of domestic abuse. Then he gave my passport back and said welcome back and have good day. 

 

This happen 3 times twice at JFK and once at FLL.

 

i flew to my home country for 4 days

 

DR for 5 days

 

Bahamas for 4 days

So you didn't have any problems coming back with AP.. how long did it take for that to be approved after you requested AP? And also have you stayed illegally in US prior? I'm trying to find out if that would cause problems when trying to enter the country with AP. Thank you

I had no issues coming back. I applied on the same day and approved. Did it at my local office. (I needed to travel the next day) before I got married I overstayed my B1/B2 by a few months.

She shouldn't concern herself with whether he gets his green card or not. Him filing for VAWA has nothing to do with child custody since there is no report of you abusing the kid. Find a divorce lawyer and figure out how best you can either have a shared/joint custody. Until either one of you have a good reason why the other shouldn't have access to the child, no judge will prevent the other from having access to the child. So no, he can't just get full custody unless he has great evidence of you putting child in harms way.

The priority date is just for spouses of green card holders because they don't have a visa number available, but immigrant visas for immediate relatives of U.S. citizens are unlimited, so they have  always a visa number available.
