If you want you  can file  for AOS  now but you have to submit a new l765 using category  C 9, plus  other forms  as well. You must submit to VSC.

Ask someone to translate the police clearance, the  person has to mention  that  he/she is  fluent  in English and in his/her native  language as well.

You  should contact your congressperson to inquire USCIS on your behalf and  you can go to infopass to find out about your case as well. They received the RFE answer last November and they had time enough to have the case adjudicated.

Because of the workload in Vermont they are submitting some l765 to be reviewed by CA field. But the l765 for Vawa petitioners should be submitted to VSC.

Sorry for confusing statement . I received rfe on 09/01/2017 case filed date 10/1/2016 third prima dacie issued after request of renewal and it is issued for 2 months rfe sending date is 11/24/2017... i hope this clarifies my question.

The USCIS 1800 number will not tell you if your EAD is valid or not, they will just say "if you have a pending AOS then your EAD is valid".

Applied for i765  (c31)last year with my i360 together. I360 approved may 2017.

Applied for i765 (c9) april 2017 and approved and recieved june 2017. 

Question is 

Last week, i recieved my ead(c31) based vawa approved. So i have 2 ead now. Is it normal?

No that seems like a mistake. Since you have i-485 pending, use the one you got under c9.

They made a mistake submitting the one that you applied for category C31. Send the EAD category C31 to VSC ,AND  submit with aa copy of the EAD (C9). explain to them that you received 2 work permits.

Is it true that if you have an initial I-130 filled by spouse and file for vawa after they can transfer the priority date from one to another and the adjudecation of I-360 would be faster? or is regular waiting time posted on uscis website? thank you

Hi Guys I’m new here,

filed Vawa base on physical and psychological abuse. I am using an attorney:

 

PD: December 7,2015

 

file 360, 485 & 765 on October 4, 2016

1st EAD approved on December 1, 2016

1st Prima Facie On October 18, 2016

1st AP On 07/31/2017 (filed and received the same day for emergency) 

I use the AP to travel a few times since with no issues

2nd Prima Facie June 14 2017

2nd EAD Filed On 9/11/2017 Approved on 10/10/2017(no biometrics) 

filed for 3rd Prima Facie on September 13, 2017. 

 

So so far no response for 3rd Prima Facie but EAD was approved in 1 month and no RFE. Hopefully I hear something for the 360 soon. 

 

I recieved a fee fee waiver for all application and I sent a very detailed filed to USCIS during the 130 and 1485 stage in December 2015 and I did the same very detailed file in filing 360.

 

i had police reports

restaining orders

court orders

pictures of abuse

arrest records

prosecution official letter stating I was never charged and that my spouse was charged for menacing and physical abuse 

Doctor gave sworn statements 

therapist gave evaluation

i had included previous documents for Bona Fide marriage 

letters from my college lecturers and tutors 

letter from my job 

and letters from friends

Letter from shelter 

 

I wrote a detailed statement From dating, marriage, to when abuse started and when I leave the marriage. 

 

 

all documents submitted are all sworn statements 

 

I’m waiting until December if I don’t get an adjudication by then to contact Congressman for help.
