If you list your children in your VAWA I-360 and once it is approved, you can file immigration visa for your children if they live abroad ( file I-485 if they are in US). Once their immigration visa is granted, they can travel to US and receive green cards.

What kind of immigration visa do u mean; visitor, F1 etc?

IB1.  You will receive approval notice and derivative children notice, with immigration class.

B2, F1 are not immigration visa.

Do u mean to say one receives immigration class notice after I485 approval? And that immigration class is what one would use to determine what form to use for derivatives application based overseas?

We were talking about AOS or immigration visa (if your derivative child is outside of US ) after approval of VAWA I-360, right?

IRS debit will not interfere in the  VAWA decision, but to file for naturalization, later on, the person has to prove that he/she does not own money to IRS or to prove  the person has a "payment plan installment agreement" and  that the person is paying the debit.

Thank you Sandranj. I sent the papers with my spouse last year in October and still don't have a date for AOS yet. I checked the uscis timeline and I think it should be scheduled in 1-2 months. Since we are now divorced and I want to apply for vawa the only form I should send is the I-360 since I have the spouse petition and the I-485? And also if I send the petition before the interview are they gonna cancel the interview or no? Since I can't afford a lawyer I'm going to try to fill everything by myself and I would really appreciate any advices here. Thank you again

Thank you @azalea3. The AOS interview I was supposed to be scheduled with my spouse should be in about 1-2 months. We are now divorced and I'm filling for vawa. Should I send a notice to uscis to cancel the interview or they are going to cancel the interview automatically when they see I filled for vawa?

They won't cancel it automatically. You have to request your I-485 to be placed on hold pending VAWA approval is what I have read on this forum. I didn't go through this hold process myself, so I am not completely sure. Maybe others can chime in.

Thank you. I also didn't understand if I have to actually go at the interview and request this "hold to I-485" in person or I have to send a letter or some kind of standard form to uscis to request this hold?  Also my EOA expires in January. Should I request an extension to EOA based on I-485 that I have now or should I send something else along with the vawa petition in order to get employment authorization? Has anyone been in this situation? Thank you
