Hello, Sandranj:

In form I-485, Part 2 - Application Type or Filing Category, which item should a derivative child of a VAWA I-360 approval check? Thanks,

As stated in the Immigration Law  "Derivative Applicant (files based on a principal applicant) A principal applicant’s spouse and children, who are not beneficiaries of their own immigrant petition, may be eligible to apply for adjustment under the same immigrant category as the principal applicant".

Can someone advice i talked to few psychologist they said they can write an evaluation report based on test they take but there will be no therapy sessions ( may be therapy is required when dv occurs in current situation and mine is old) is it ok as may dv had happened 2 years back so is it okay to go for that one also doctor suggested i can take the benefit of mental health bills payment from victims compensation .. how true is that if i apply after2 years what they gonna ask me. and what are chances of getting as i had to pay the doc first he is asking $500 for evaluation..

thank you all .

This kind of evaluation has no weight whatsoever. You have to attend  5/7 therapy sessions. The professional must write:

Your background

Onset of the problems

Tell the abuse in details

Tests performed

Diagnose

Treatment plan

Referral

Please can someone confirm if I need a forensic psychologist for the evaluation or if a clinical psychologist is okay. My current psychologist is clinical and she says a forensic does for court issues. kindly confirm this please. Thanks

You don't need a forensic psychologist.

Thank you Sandra! my psyhologist was suggesting that since I will be taking therapy with a counselor from the shelter

Make sure the psychologist will draft an evaluation mentioning the tests performed, HSE MUST WRITE DOWN the abuse in details and diagnose.

Include details in your personal declaration. Also, if there were friends/family members who saw this or knew of it and supported you, get statements from them describing the details as well as the physical and emotional impact on you. Include the pictures too (although I don't know enough about whether or not they will accept them as proof, it can't hurt to include them). The treatment documents should also be included even if they were from a year ago. You said you are receiving treatment for anxiety. So, are you getting therapy for it already? If so, include a letter from the therapist. If you mean treatment for anxiety through medication, ask for a letter from your physician describing your anxiety and what you told the doctor about it. The more information/details you can include about the abuse, the better.

Hi everyone.

I literally just had my AOS interview after the approval of my VAWA. The interview lasted 10 minutes and the officer was courteous at all times. I was asked the yes or no questions and a few questions regarding where I lived and when we split up and things like that. I was NOT given a decision on the spot and I was told that they had all the information they needed at this time. They gave me a paper stating that they have 3 months to make a decision and that if I don't hear back from them at that point, I should make an infopass.

I am EXTREMELY nervous and I have no idea what to think. I am so afraid if it being denied that I don't know what to do. My attorney said she could tell I was nervous on my interview but that I shouldn't worry too much.

Can anyone please provide some insight or explain if this is the standard procedure. I've read so many things that I can't even put my thoughts together anymore.

You said "...He pushed me and my right eye was hurt and got red and he threw coffee on me while sitting with him on dining table so i got burnt mark on my neck tummy chin pics are 2 yrs old when i was in my country my throat vocal chords were swollen and I was not able to speak for 3 months.... Considering what you said the abuse occurred OUTSIDE OF THE U.S. You can file for a self-petition just if the abuse happened in the U.S. There is an exemption for spouses abused abroad if the abuser is an employee of the U.S Government and while living abroad subjected the victim to battery or extreme cruelty or if the abuser is a member of the U.S military living abroad as well.

Hi everyone and @sandranj

i am confused about the work permit if anyone can help.

can I apply I-765 only to Vermont or does it have to be together with i485?

Thank you for your time and help

Additionally
if husband is USC, than I can file 1485 and i765 with i360 in VSC. What if USCIS put i485 on hold until VAWA approved, how do I get my EAD then?
Thank you

@sandranj

please advise

thank you for your time
