Hello Everyone,

I got the 5th Prima Facie this weekend, I am disappointed it's on the 16th month which is almost triple the time I originally anticipated, but I am still hopeful and praying for good news soon for all of us.

 

 

 

 

Timeline: 

May 2016 retained an attorney and started to prepare my VAWA petition. 

11/08/2016 mailed my packet

11/28/2016 USCIS rejected my packet (expired forms) :(((  

11/29/2016 Mailed my packet again Via ExpressMail (I-360, I-485, I-864w, I-765, I-912, G-325A) with previous rejection notice on top & a request to expedite EAD

12/14/2016 Date on the NOA  

12/31/2016 Attorney emailed my Prima Facie (Notice date 12/19/2018)   (180 days)

01/14/2017 Mailed my husband’s birth certificate with the blue receipt that came with my Prima Facie

01/17/2018 I-360 online Update (correspondence received)

12/25/2016 Notice for Biometrics

01/12/2017 Biometrics completed

01/31/2017 EAD update (Ordered my new card)

02/04/2017 My first EAD delivered.

02/06/2017 Picked my EAD & applied for SSN

02/14/2017 Applied for state ID

02/15/2017 Applied for Medicaid

06/03/2017 Received my Prima Facie (180 days)

10/22/2017 Mailed EAD Renewal  & AP & Waiver (I-765. I-131, I-912) and request to extend PF

10/24/2018  Attorney emailed my interview notice

11/05/2018 Completed the medical (I-693)

Some lawyers suggest to wait in case a person files  VAWA petition and it takes a long time then gets denied in the end.

  • If you are still married or divorced within two years or less then you can re-apply for a new VAWA.
  • If you got divorced before filing and it takes two years but doesn't get approved then a new VAWA is no longer an option.
  • It's sometimes safer to wait just to keep this option open if ever needed, hopefully not.

 

 

Even you file vawa with I485 and get deny and you can still have this option to file again as long as you still married?

If one submitted I-485 and VAWA is denied they may be subject in removal proceedings.

They can apply for VAWA again if qualified.

 

I am not certain if the person gets denied & decides to apply for a new VAWA petition, Do they submit a new I-485 or Is it possible to hold the pending I-485 which was filed before ?

I'm going on 15th month and this is only my 2nd prima facie how come youve got 5?

Yes correct another 60 days I am very patient and I am praying a lot for a positive outcome, please pray for me as well I truly need it.

I recieved two PF valid for 180 days each. 

The last 3 PF docs were 60 days each so basically I have to renew every other month!

You can always make an InfoPass appointment to see if they can check if VSC already sent it out.

Hi 

how many days after filing vawa you receive email or reciept from Vermont service centre that the case  was received.. its 2 weeks received nothing ... check also not cleared for I 485 fees 

what to do ..???

It varies but typically 3-6 weeks have been reported before getting the NOA

If  VAWA is denied the person can file the VAWA petition again. If the person has the I-485 denied the person has to  file a new I-485 .

You don't  have to be married to file or refile VAWA. The person has  only 2 years time limit after a divorce  to file for a VAWA self-petition.

Yes it's normal,  some officers just work faster than others.
