No I didn't get any letter to appear to any court. And how would someone know it is fraud related as u said.

On my i485 decision it stated that my lawful nonimmigrant status had already expired that I am not authorized to remain here and I should make arrangements to depart soon as possible.

Your denial letter will explain why they denied your application. When my stepdad filed for me mine was denied because he married my mom after I turned 18 so I didn’t qualify as him immediate family. That was a couple years ago.

Mine stated that too and I never got any letter to appear in court either.

@sandranj and all - I applied for AOS based on approved VAWA by the end of Jan. Had my biometrics done in first week of March but my case hasn’t been transferred to the NBC yet. Others with the same timeline had th case transferred few weeks back. Is this normal?

Are you sure it hasn’t been transferred yet? USCIS is not good about updating the online status. Have you verified that is has not been transferred yet and they might have just not updated the system?

I just took a look at the status online. How can I verify? Is there anything I can do at this point or should I just wait?

They are not very good at updating the online status. I would give them 60 days and then make an InfoPass appointment at your local field office to inquire if they have received your application.

Yes they will look at your previous petitions filed.  Why were u denied the first time?  Did you file documents with second husband?  How did u enter the US?  You need to get a lawyer.

It takes an average of 4 weeks. Some get it sooner some later. Mine took 6 weeks.

I didn’t apply for PF extension but they automatically sent me a new one. The old one expired end of August and the new one came beginning of October. 

You can always make an InfoPass appointment to see if they can check if VSC already sent it out.

Some lawyers suggest to wait in case a person files  VAWA petition and it takes a long time then gets denied in the end.

  • If you are still married or divorced within two years or less then you can re-apply for a new VAWA.
  • If you got divorced before filing and it takes two years but doesn't get approved then a new VAWA is no longer an option.
  • It's sometimes safer to wait just to keep this option open if ever needed, hopefully not.

11/28/2016 USCIS rejected my packet (expired forms) :(((  

11/29/2016 Mailed my packet again Via ExpressMail (I-360, I-485, I-864w, I-765, I-912, G-325A) with previous rejection notice on top & a request to expedite EAD

12/14/2016 Date on the NOA  

12/31/2016 Attorney emailed my Prima Facie (Notice date 12/19/2018)   (180 days)

01/14/2017 Mailed my husband’s birth certificate with the blue receipt that came with my Prima Facie

01/17/2018 I-360 online Update (correspondence received)

12/25/2016 Notice for Biometrics

01/12/2017 Biometrics completed

01/31/2017 EAD update (Ordered my new card)

02/04/2017 My first EAD delivered.

02/06/2017 Picked my EAD & applied for SSN

02/14/2017 Applied for state ID

02/15/2017 Applied for Medicaid

06/03/2017 Received my Prima Facie (180 days)
