Are you serious ? I need my divorce I don't want to stay married to that monster and she insist to wait until it is approved....I need to go visit her because she joking big time ...

My lawyer advised me to file for divorce b4 even filing for vawa. Divorce does not take one day to be final,

Yes please file asap and get yourself to safety! You can read this information on all official VAWA communication on USCIS website. Read the instructions file.

Trust Sandra and the experience of people on this forum over an attorney. Many people on here have been misinformed or screwed over by their attorney (me included). You don’t need to spend money on a family law attorney to file for divorce, you can do it yourself if you don’t have kids or assets to divide. 

 

Here is what the USCIS official I-360 document states on page 6/16:


“NOTE: You may file a self-petition within two years of the date of the U.S. citizen abuser’s death, within two years of the U.S. citizen or lawful permanent resident abuser’s loss of status as a result of an incident of domestic violence, or within two years of the termination of the marriage to the U.S. citizen or lawful permanent resident abuser if there is a connection between the termination of the marriage and the battery or extreme cruelty. For self-petitioning spouses, you may remarry after USCIS approves your self-petition without affecting your eligibility to become a lawful permanent resident or have grounds for revocation of the approved self-petition.”

@iwillsurvive I asked her over and over again said I am to wait just in case any difficulties I wont be divorced ....She drags my case out with everything ...my i130 denied September she didn't refile my new doc until November...Sometimes if we only know things before hiring these lawyers ...

Unfortunately we are in a vulnerable situation when we are hiring an attorney to help us with VAWA. It seems like finally someone is able to take a little bit of chaos off our hands but sometimes it can turn out to be quite the opposite when we blindly trust them. I have learned that the hard way too. 

At this point I make all decisions myself based on information I gather here and just use her as my mailing address and to file renewals for me but I take charge of everything now.

Hello Sandra and Friends, please I would like to ask a question. Last 2 years my 1st spouse filed i130 and i485 for me and it was denied, now I am filling vawa with my 2nd spouse. Pls would they go and review my old case that my 1st spouse filed for me. Thank you

The cause of denial has a lot to do with it in my opinion. Marriage fraud for example would be more serious than residence requirements or other requirements.

In your denial letter was you ever order to appear in front of a judge for proceedings? If yes did you attend? If not I think you’ll be fine as long as the denial wasn’t fraud related.
