Good day, Sandra, thank you for all you do for people like me. Sorry to be so annoying and bother you again, but

I have a few more questions, please.

 

After marriage to us citizen, I got ssi, ead and even date of interview in March 2016. But it never happened -  my husband started to abuse me and we did not show up together to the interview. My paralegal asked IO to hold my i-485 cause I was going to file i-360.

Then my lawyer filed i-360, ead and advance parole, but not i-485, which was frozen.

My i-360 was approved in February 27 2017 (right after that - in March 2017 I got a new EAD),  got notice of approval in April 24 2017, and then my lawyer asked uscis to reopen my frozen i-485.

Till now I'm waiting, uscis never updated my account on website. Last October they sent to my lawyer a letter - not rfe - to send new medical records, that we did. I made inquires, called them, went twice for info pass, but did not hear from them nothing but wait.

 

Could you explain me something - was my lawyer right to hold my i-485 and not submitting it with my vawa case? Maybe I have to submit it now?  Did she make it right to ask uscis to reopen my i-485 after vawa was approved? Or they would automatically start working again with my i-485 without her request ?  Could medical records be a factor that stopped working uscis on my case? And what time line for my i-485 is right, if my vawa was approved in February 27, 2017 (only after that - on March 8 - I got renewed EAD) and my notice date is April 24, 2017? Or maybe it could be another date as my timeline, like the day my lawyer sent request to reopen my i485?. I checked the site that states that in December 31 uscis had finished working with cases up to February 20, 2017. So my timeline suppose to be now.

I'll go to info pass next week and want to be ready to talk with IO . Thank you again

(My AOS is going to be tricky so I was advised not to file it together)  You can always message me if you need ideas on how to survive, we are probably not in the same state but I've gotten good at finding local resources in order to survive and have learned a lot, and I'm always willing to share the stuff I've learned!

Gramercy, I don't think she meant lucky in any ill or offensive way.  I think it goes without say that most of us on this forum have suffered abuses that no one should ever have to be put through.  Everyone's situation is different, let's support each other, not tear each other down. :)

 

@MsVi2 thanks a lot for explaining that to him,or her I didn’t mean any bad intentions so I don’t know why he took it like that,I won’t say anything to him or her!was just saying that at least some people can work why some of us can’t even work or drive,or take the kids to their appointments.

Thank you@ Sandranj. Please i should explain why we do not have such joint stuff in my personal affidavit or on a separate write up. Please i need help on this, my i 130 and i 485 got denied because my husband did not show up for the interview on the 02/13/2018 and a received a denial letter on the 02/16/2018, stating  that i can not appeal my case but i can file for motion to reopen within 30 days. I have a lawyer but he is not helping, he is not telling me what documents am suppose to put together for vawa, i've been doing the research by myself. My denial letter was sent out on 02/13/2013 and it's almost very close to the 30 day period i've not file for vawa, still gathering my documents, i'm currently seeing a psychology that i was referred to by my primary care doctor.  Can i asked my psychologist to write me a notice that i am currently undergoing counselling so i can add it to my documents and file vawa since time is not on my side, i can send the evaluation letter. my lawyer is not bothered about the time, i am so scared bc they might put me in removal proceedings, since am out of status. Please your candid advice will be very much appreciated. God bless you for the good work you are doing.

 Uscis sent back my ead renewal 2 times already asking for me to pay the fees so my lawyer sent it all back with a fee waiver this time. He told me that if a c9 is completed jointly with a i485 we aren't supposed to pay the fee

I spoke with USCIS customer service and again when I went to infopass the officers explained:

if you initially paid the fees for the first I-485 and EAD it wouldn't be required. but if you waived the fees the first time; they expect you to either include the fees or a fee waiver request.

 

I even had my I-131 returned to me when I sent it with a waiver before based on the assumption (if you can afford to travel, you can pay the fee)

 

When my EAD was due for renewal, last October I mailed I-765+ I-131 + I-912 waiver and got the combo card.

 

 

@#Godgotthis Check the table of fees and follow the form instructions to prevent delays. it also won't hurt to verify the info by calling USCIS customer service.
