Your state should have more than one senator who can help you, either keep bugging your congressmen to bug the Congressional Liaison for a response, or find another Senator to bug them.  Dealing with Government entities when they aren't responding is one of their duties to you as a resident of their state. 

 

It took over a month for the Congressional Liaison to reply to my senator's staff and a day after his response I got my first RFE in January 2018.

 

Keep bugging them. I'm still waiting for decision, I filed Nov 2016.

They are wrong. USCIS often makes stupid mistakes, not that long ago USCIS issued a green card  valid for  2 years for a VAWA petitioner  adjusting status when the Law clearly states that VAWA petioners adjusting status must receive the GC valid for 10 years. Crew members can't adjust status in the U.S one visa journey member too had an interview and the officer told him that he could not adjust status because he was a crew member, but i advised him if this happened he should ask to see the supervisor.He asked to speak with  the supervisor and of course the supervisor told the officer he was wrong, the guy could adjust status because he was a VAWA petitioner.I can go on and on about their mistakes.

I only received this RFE. That is my first one.

They approved my EAD before I answer the RFE. They sent me the RFE January 31, approved my EAD February 22 and I haven't answer my RFE yet.

In this case there is not time to answer  THEM but try toa nswer asap because your case stopped when you got the RFE.

We had several people in removal proceddings before.In case your VAWA is approved you must ask to terminate the removal otherwise USCIS has no juridisction and they will deny your AOS. It's advised to contact USCIS counsel after VAWA approval to ask him to sign jointly the petition to terminate the removal proceedings.

Submit what you have and explain what you do not have and why not, such as tax returned filed jontly, joint bank account, health and car insurance with both names etc..Submit affidavits from family and friends as well.Read vawa  threads part 6,7,8 and you will find a lot of information about VAWA.

Thank you very much! I trust your experience. Seems like USCIS employees aren’t always the most knowledgeable. I wish they had an official explanation online for a lot of scenarios like this. I am sure I’m not the only one where my attorney is in a different county than where I live.

Hello Sandra,thanks a lot for all your help and answers to our questions!Please i’m Very worried right now!Please I need you to clarify this,Some members here said that if you file only 1-360 it will take like two years for USCIS to respond to your case is that true?I was told that if you spouse is a is Lpr you can only file for 1-360 so does it mean they will keep my case aside??and other members says that if you over stayed in US and ur visa expired they will not approve or take long to answer your case!please I know you are an experienced lawyer tell us if all this is true!thanks a lot for understanding!Gid bless you!
