In my little way of understanding this letter

1. They're requesting police clearances from each place you've lived more than 6 months within the last 3 years OR You can submit an FBI Nationwide background check as a single document instead of multiple State Police clearances you've lived in more than 6 months.

 

2. This requires you to submit your personal affidavit narrating how you met your abuser, through dating, courtship,  marriage, the abusive moments  up to your current situation now. (It may be long to write but please do the best you can). You may notarize it too. Get similar statements from from friends and family (parents and siblings) stating that you were married in good faith. (It's optional for them to state the abuse you were going through if only they were aware of it, if not their knowledge of you dating/courtship and marriage with dates is okay.) They may notarize theirs too.

 

In summary that's how best I can understand and explain this notice sent to you.

But please verify with @sandranj for very specific guidelines as to how to respond to this request. She's our only source of hope and the only one we look up to in dire situations.

If the marriage was annulled, you were technically never married and don’t qualify for VAWA. You may try to see if you qualify for U Visa. Unless you can get a family law attorney to help you fight the annulment if it is not through yet.

Yes. If you end your marriage in the form of annulment, you are not eligible for VAWA case and green card because your marriage is not valid.

 

Vawa is based on valid marriage.

But what if the annulment is based on the USA wife citizen who is mentally dis ordered and incompetent?   I 've filed for vawa since December and will I get vawa approved and green card if the annulment is based on the lack of competence and incapacity of my us wife ?

It doesn't make any difference. USCIS will pay attention to whether your marriage is valid or not, not who is in fault. I don't think you will get approved. A very similar case happened in this forum a year ago. You can't have your marriage invalid and apply for VAWA based on valid marriage.

I'm new to this forum and I'm in the process of applying for VAWA. I'm almost done with the paper work, I have pictures of the physical abuse, an affidavit I wrote with 22 pages providing, the emotional, mental, and physical abuse I endure with him. Proof of our marriage with pictures we took together when we where going out and when we got married. I'm still doing the psychological evaluation, but I have gather documents of 2 police reports, and one restriction order I recently did. My mom, did my affidavit providing my residence with him, since i didn't own a home with him, and we resided with his parents, but in further evidence such as texts, and pictures, our residence together is testify. I also have texts, with threats and also he begging me for forgiveness, and ratifying that he actually did hit me, and also texts providing  his abuse to me. The only thing that is left is to provide and show that he is a U.S citizen, I know that I just need to ask that in the county where he was born or in the dshs of the capital of the state I live, however, the only thing is since I live far away from the place I use to live with him, I don't know if I can provide a picture printed out for our marriage license instead of a copy. Can that work as enough evidence that we are married or do I necessary have to get a copy of the marriage license in the county where he was born?

You can get a copy of his birth certificate online as long as you know his basic information.

Do you mean those who didn't get the prima facie their case is not strong enough? Am confused cause I never got a prima facie myself it's been 8 months now nothing has happened since they received my case

Could you share what evidence of abuse and bonafide marriage you submitted?
