I really hope USCIS could speed up the processing time, otherwise 2017 and 2018 petitions will wait 3 or 4 years to get green card. We are all aware that you can't get married during this waiting time, better not have children because you have to explain to the USCIS. How many years can we really wait? Not to mention, the uncertainty about work permits, jobs and travels. 

Don't want to complain, but hate to see USCIS gets slower and slower.

One can re-marry after vawa approval even if I-485 is pending. And yes you can kids because USCIS will not crucify one for having kids with another man. The only problem is getting married before vawa approval.

God is the greatest!! My vawa just got approved!! Thank you to Miss @sandranjand to everyone who’s here, you guys helped alot in this journey.. 

 

 

i just have problem now.. 

 

my previous I485 from previous marriage was put on hold til they have decision for VAWA.. now my lawyer wants me to file a new 485, pay again for it and pay her again for her service w/c is ridiculous!! I explained to her that my 485 is still pending, and thats reason why I was able to renew and renew my work permit over the past two years.. she was insisting to file and telling me its better to file than not too as she was saying if everything from previous 485 is carried  over, USCIS will return the money.. I want her to understand but I dont want to argue with her coz she might take it against me..

You don’t need to refile your lawyer seems to be looking for money and refiling would push you back further as far as waiting. Congratulations on your approval

Thats what I kept tellinh her but she wont listen. Seems like she doesnt know anything about it..

oct 2016

nov 30 - interview for AOS for my husbands petition, the officer put a hold on my 485 til vawa decision..

March 2017 - renewed my work permit under c9 category

may 2018 -got my renewal of work permit

sept: another prima facie but this time 2 mos only..

late oct - received rfe for good faith of marriage such as common finances etc etc..

january - miss sandra helped me out in answering the RFE and she is the best!! Submiited exactly one week before the due date..

Yesterday - got the approval

We have comingling finances but just didnt have too much transactions on it. We had credit cards together, joint account. Our landlord letter.. and affidavits from friends and family..

3. For I-485 timeline, do they use VAWA approval date to count from? I assume they don’t use original receipt date because then we would all be overdue by the time it gets to local field office (when having filed concurrently).

If I move to a different area with faster field office processing times for I-485 before my VAWA is approved (and do a change of address), will they just send it to the field office closest to my new home address? Can there be a delay in processing at all if I do all this before VAWA approval? 

 

5. Could I just open a mailbox in a different field office area and change my address to that? I know many people that use mailbox address on their driver’s license etc. Does this work or will USCIS not accept this? Technically it looks like a real address, so would they even know it is a UPS mailbox?

They  choose the office considering your attorney address.. You cannot rquest to have the interview in a different office, just if you moved out of the State or  when the person doesn;t ave an attorney and move to a different County then they will setp up the interview considering where the  person is living,otherwise they will consider your attorney address. The timeline for the AOS  starts when the NBC receives the file.
