For most of you, your spouse is a citizen, so you can get work permit before your Vawa is adjudicated. You don't have a priority date because the visa is always current. But for spouses of LPR, they can't get work permit until vawa is approved. 

 

@Hopeful diva, you are very lucky. Perhaps the officer who worked on your case is very efficient. 

 

But on my vawa approval letter, it had my priority date as the same date on my I-130. So what does that mean? My ex spouse is a US citizen

I need to renew my i-765

Expiry is in feb 2018

Q1: Is there a filing fee for the renewal?

Q2: Which category i have to use to file i-765 as i have approved vawa and pending i-485

Maybe I am wrong with the priority date. No matter whether you are a spouse of a citizen or a LPR, you will have a priority date. Perhaps spouses of citizens don't need this priority date since they don't need to wait to submit I-485.

Wow  that's insane. I think my husband is trying to play the victim card purposely like that to say his life is so hard and he's going through so much turmoil by turning everything around on me and starting arguments when he is wrong for his behaviour as a husband and father. I filed a fraud complaint and will go from there. Hopefully they help and investigate.

I think that will be fine. Make sure that the person is licensed. My letter was from a licensed marriage and family therapist, and my VAWA was approved. As long as the licensed professional has met with you long enough to have a sense of the abuse and is able to write about the psychological impact this has had upon you, it should be okay.

Oops - I just posted a message slightly contradicting what you said here sandranj. I will defer to you since you have seen thousands of these cases.

 

There are far too many people who style themselves as "counselors" and are not qualified. However, if the mental health professional has a Masters in a mental health field, and is licensed by their State board, then that means that they should be qualified to write these letters. A masters level counselor will not perform psychological testing. Only a psychologist can do that. However, they will be able to provide a diagnosis as long as they have met with the person a few times. Also, many therapists who don't have experience in this area just won't do a thorough job. So, whatever you do, please only see a licensed mental health professional. Also, please ask the therapist or psychologist in advance if they can provide you with an in-depth letter providing substantial evidence that you are psychologically impacted by the abuse. It is best to describe to the therapist what it is you want, how in depth it should be, ask to include diagnosis, include descriptions of the abuse and in detail the psychological impact the abuse has had on you, etc. If they can't do that, then find someone else. Please don't go to a counselor and say, "I want an evaluation" and then be surprised at a short or inadequate letter.

Adding something more here.IF the counselor has  experience working with  mental health counseling or with therapy for victims of domestic violence then he/she will be able to perform an evaluation,but you should discuss this before you startthe  therapy because many of them decline to perform a psychological evaluation, and some of them draft just 2/3 pages,and of course  a professional cannt describe everything in 2/3 pages.

Just want to post a message to thank Sandranj for her help in filing VAWA I-360. I filed VAWA I-360 for a lady at the end of Jun 2016, and PM Sandranj for many questions, which were promptly answered so that I filed her case correctly, even without a RFE. Now that her VAWA I-360 is approved,  I would like to post her timeline as well as a thank you message for Sandranj.

 

Timeline:

6/27/2016: VAWA I-360 filed

7/7/2016: I-360 receipt received

7/11/2016: Prima Facie received

1/5/2017: I-485 and I-765 filed

2/17-2/21/2017: I-485, I-765 receipt received

3/22/2017: Biometrics appointment

3/27/2017 EAD approved (received about 10 days later)

May 2017: Contacted Senator for case assistance

Jun 2017: VSC informed Senator that her background checking caused her case out of normal processing time

Aug 2017: VSC informd Senator that her background checking complete and sent to final adjuducation

9/18/2017: Case (VAWA I-360) is approved!

Thanks Sandranj and Azela for guidance im seeing few tom in which one is Family therapist but not too that old in dealing cases others are psychologist but all have sliding scale eith price from $80-120 per session may be for evaluation separate fon't know... im worried i will update whatever happens... pray for me.. thx
