Asking for my friend, a lady I got acquainted 2 years ago, she also went through abused nightmare, and we exchanged our bad "experience", her case was approved year ago and she'll have an interview in 2 weeks. While her case for vawa  was pending, she knew that her husband died (overdose), she got news from their friend, her lawyer did not recommend to inform im office at that time. Then the case was approved.

So, Will it be a problem on interview, could  they ask her why she did not say about it earlier?

I'm a little confused.  Were you married to someone else in your country, and the divorce wasn't finalized before you married your abuser the first time?  If the original marriage wasn't valid and isn't recognized then USCIS would be correct in stating that the abuse didn't occur while you were legally married, therefore you didn't have a qualifying relationship when the abuse took place. 

 

The US recognizes foreign marriages as valid, if you were married to someone else and then married your abuser before the divorce was finalized then you would have been committing bigamy, therefore any marriages before your divorce was finalized would end in annulment.   However if you were married to your abuser then it would be recognized.

 

I'm just trying to understand your situation. 

 

Did an attorney help you with your VAWA, or did you do it yourself.  I would think if an attorney helped you they would have realized the conflict before filing anything.

I have been waiting for 18 months now.I suppose I can wait a few days to get the decision in the mail.

 

Can I schedule an Infopass and they tell me what the decision is?

Good Morning Everyone!

 

One more question..

 

A few months before my abuse my husband (USC) had file to adjust my status. We filed I-130, I-485 and I-785. By the time I left him I had already received my work permit and was waiting for interview. At that point, I filed for vawa (May 2017) and changed my address from California to Florida on that case where my husband was petitioning for me. I never received any notice from USCIS regarding that case. Not the interview notice, nothing. My husband had threaten to withdraw the application but how can I know? If I go online the case status is "We will review your response to our request and mail you our decision"  It has been like this since November 2016 when my husband filed the application. Now, when I filed VAWA in May 2017 I only filed for I-360. I thought that I couldn't file I-485 until I-360 was approved. What should I do? Should i just leave that case alone. And file I-485 again once Vawa is approved? Or is there a chance that USCIS just put the I-485 that my husband filed on hold because of VAWA, without me requiring this? Would it take longer to get the GC if I file a new I-485 now or when VAWA is approved? I'm so confuse I don't Know what to do. Any thoughts would be appreciated.

Yes ur correct i married the military guy when the marriage in my country wasnt finalized with a different person and then remarried the military guy again ..yes i have an attorney but she doesn't look worried at all .. but i am worried

I applied just 6 months before exp as it says you have to apply not less then 60 days to expire .. all the copies of current unexpired ead i797 noa pending i 485 cover letter i 765 form for ead for renewal i360 noa copy

My i360 was received 1/24/2017. I have not heard anything it only says Fees were waived. Should I wait longer? or start worrying? Thank you

hi my i-360 was received on 1/13/17 we are like a week apart I am waiting too for my approval lets wait and see I submitted my ead renewal so let's see what happens next
