Is licensed Marriage and Family therapist also can do psychological evaluation or it has to be psychologist only??as most of them i see is MFT

Hello all,

 

I am in a very complicated situation.

I applied for abuse waiver. Biometrics done.

My spouse already applied for divorce

Now my spouse want to reconcile. Spouse is saying, she realised her mistakes and work out together.

We were truly in love for 2 years, even I liked her very much and misses her.

 

Now my question is, if we reconcile, how to handle my immigration status?

Do, I need to withdraw my I 751 and file a joint one later? or  can I leave it as it is?

USCIS just updated processing time for VAWA as of July 31,2016. They are very backlogged.

 

As of 4/30, the processing time is 7/25, 2016

As of 5/31, the processing time is 8/8,2016

As of 6/30, the processing time is 8/15, 2016

As of 7/31, the processing time is 8/22,2016.

That means they are currently working on October applications

So basically it takes them 1 month to go through 1 week worth of petitions. 

 

If it continues in this speed, then it would look like this for the future:

8/31/17: 8/29/2016

9/31/17: 9/5/2016

10/31/17: 9/12/2016 

etc. 

 

Hoping it will get faster again soon :(

Why are they so backed up, from what I've been gathering the previous years it used to be faster? 

More vawa applicants I guess ... it's probably double or triple the number of applicants from previous years

 Mine is already over 344 days. 

My receipt date is Sept 26th and Notice date is Oct 6th, did anyone in those days got approval already ?

I didn't file in October and my petition is not approved yet. 

 

Just did some basic math looking at the processing times posted.

I want to give an advice for those filing Vawa based just based in mental abuse you must find a PSYCHOLOGIST to perform the psychological evaluation. I receive often letters from counselors and psychiatrists. Counselor cannot diagnose and cannot perform evaluation, the psychiatrist can perform tests but their evaluation is short and basically they don't mention any circumstance of the abuse, then immigration usually does not give weight to this kind of evaluation. Before starting therapy ask the psychologist if he/she has experience involving evaluation to submit to immigration or to the Court, if he doesn't have experience in this area then find another professional.

Please DO NOT SHOW YOU AFFIDAVIT to the psychologist ever. I saw at least 5 cases here in the VJ the psychologists copied 100% the affidavit and just put in the evaluation, and of course this kind the evaluation immigration will not take into consideration. I saw two cases denied that USCIS stated the evaluations were basically a copy of the aliens affidavits and not their psychological perception as a professional, when they asked my help was too late. 

The psychologist must mention circumstances where you suffered control, humiliation, degradation, isolation, threats etc...
