i submitted every possible thing i could place my hand on. i had paper or picture representing each of the following.

 

  • declaration describing your relationship with the abuser and the abuse you suffered
  • police clearance records and/or other evidence to show you are a person of "good moral character"
  • a copy of your passport or birth certificate
  • proof that the abuser is a U.S. citizen or green card holder
  • proof that you are the abuser’s spouse, child, or parent
  • proof that you lived with the abuser
  • proof that you suffered abuse, and
  • proof that you currently live in the United States

This is the guideline i used. i submitted stuffs( papers or pics) the represents each category.

  • declaration describing your relationship with the abuser and the abuse you suffered
  • police clearance records and/or other evidence to show you are a person of "good moral character"
  • a copy of your passport or birth certificate ( mine)
  • proof that the abuser is a U.S. citizen or green card holder
  • proof that you are the abuser’s spouse, child, or parent ( marriage cert)
  • proof that you lived with the abuser ( utility bill receipt)
  • proof that you suffered abuse, and ( testimony from my friend who witnessed first class)
  • proof that you currently live in the United States

Don’t worry.. I have heard cases were the RFE were for proof of the abuser’s legal status(citizen or LPR). With all that evidence you shouldn’t have much issue. You will get approve!! Best of luck. 

if abuser is LPR, does it have any influence on case? Can it cause delay?

There are no differences as long as the adjudication of VAWA I-360. The I-360 filing date(receipt date) or your previous I-130 priority date if any is your priority date. You can only file I-485 or start visa processing once the priority date is current (there is a visa for you).

Are you sure it is certified letter, not priority letter from USCIS?

Many received certified letters with denied notice but not always. Why not check your online status?

yes it's certified, they left in post office and i checked on the site. Is that very bad news?

:) i do have receipt number and i'm checking it every day... nothing changed..  next 2 days post offices are closed, and I just want to know when does uscis send certified letter? I googled and they say it isn't a good news.

It may depend on the field office processing timeline. However, people in this forum reported from 3 - 9 months from transferring to NBC to interview. As I understand NBC will process background check, which may vary from case to case.

It currently takes about 13-15 months for I-360 to be adjudicated. If you receive an RFE, add a few months to that. After approval, your I-485 is sent to the NBC, which takes 30-60 days. They then send it to your local field office. Processing times vary and can be anywhere up to 9/10 months (you can look up your field office). So everything can take over two years if there are RFE’s and you live by a busy field

office.
