Hi ...am new to this forum and was directed to this thread and found v helpful.Just summarizing my case for senior member input @sandranj

Am a Pakistani physician ,single mother of an 8 yrs old daughter who is a US citizen and I gave her sole custody .My ex husband is a US citizen and my 7 years of married life was very abusive and cruel.I have never been to US and my child born in Pakistan.Am living and working in KSA with my daughter on work permit and so is my ex.only last week I came to know about VAWA as an option to immigrate to the US and was encouraged by kind helpful member here that I can apply from overseas through the local US consulate as well.

My divorce was finalized in Feb 2016 and then I got the sole custody of my daughter followed by her US passport and CRBA all through the Consulate here.

I wanted to access my ex husband's US passport copy for the VAWA petition as all soft and hard copies I had were destroyed by him.

Though I have his name mentioned on my daughter's US PASSPORT, Pakistani Passport and CRBA as her father and mine as the mother,do I still need his passport copy as a definite evidence?

You can file VAWA if you are living abroad just if you husband  is an employee of the U.S. government or armed services, or the abuse occurred in the United States. It seems the abuse occurred outside of the U.S and your husband is not  an employee of the U.S. government or armed services, that being said you do not qualify to file VAWA.

 You  need to check in your  Country if your  religious ceremony  has civil effect. If it's recognized  as a valid marriage then you are married for immigration  purposes.  If not then  you  need a SINGLE STATUS CERTIFICATE.

 

Two years ago I helped here on VJ one guy from Uganda. USCIS  understood that his religious ceremony had civil  effect,  I proved to Uscis that he was single.His case was approved.

 

I remember here one girl from Kenya  that had her VAWA denied because she had a Tribal wedding  ceremony . She found me here and wanted me to help her to file a new Vawa, but  I searched about the customary marriage in her home Country and I understood that  she was married for immigration purposes then I declined to help her. Another attorney filed a new VAWA for her  and the VAWA was denied again.

Well I was informed of the contrary, as long as he is a US citizen. And yes all happened outside US and neither is he a Gov employee.

sandranj is correct.  You are not eligible for VAWA.  From the USCIS website
