@miloy001, I know of someone that was already pregnant before she got separated ( not divorced), she filled vawa when she was 5months Prego, her baby is just 5months old and she just found out she is pregnant again with vawa still pending, she wanted to know if that would be a problem considering the time between both pregnancies. I couldn't give her an answer because I don't know the answer to that. I will appreciate any response.

I live in the state of Florida and I got a temporary Driver License, for 60 days but the expiration date is the same as the Prima facie letter.

I went to the DMV with my Prima facie letter, marriage certificate and an old DL if you do not have DL take your country passport, and a copy of page 16 to show to the clerk (most of them don't know what to do)

Page 16 says: I-797 for I-360 Battered Spouse Description Battered Spouse of Lawful Permanent Resident (LPR) or United States Citizen (USC) Required documents:

• I-797 for I-360 approved or

• I-797 for an I-360 pending must state “Prima Facie Case” has been established.

• Marriage certificate (only if available). Lawful entry is not a requirement. Length of DL/ID Issuance Same as expiration date of document, not to exceed one year from date of driver license or identification card issuance.

Comments • See the Verification of Lawful Status System section (LIR18) for the FDLIS issuance requirements.

I filed my vawa case on May 2017 and I'm on second Prima Facie now. My case included 2 restraining orders ( 1 in family court and 1 in criminal court), Police report (were physical injuries were stated), Therapist Report, Letter from the shelter I stayed and pictures of our wedding and many other things that prove the domestic abuse, good faith marriage and other requirements. I feel that with all of this evidence I have a strong case, in God I trust that this will be enough for USCIS. However, I'm a little concern with the processing times. According to the USCIS web site on October 31st 2017 they were reviewing cases from September 12, 2016. WHY ARE THEY TAKING SO LONG??? Before, this was a process that took about 9 months. I check the website almost every day. I'm getting desperate. Are any of you in the same situation? Can you guys share with me how was your process and if you cases got approved or not?  Also, I see many people saying they filed for work permits along with form I-360. My lawyer said this wasn't possible. Any thoughts and comments will be appreciated.

Yours was filed in May, 2017. You still need to wait for at least half a year.  I have been following this forum since the beginning of 2017. It took 12 months for September filers to get decisions. 14 months for October filers to get decisions and this month is the fourteenth month for November, 2016 filers who are still waiting. It will take longer and longer if nothing changes. So if you have a pending 485, I will suggest you submit I-765 to get work permit so that you can work to support yourself.  Otherwise, the financial burden will make you more stressed during this waiting.

If you have prima facie, you can use it to get FAFSA to study. 

 

If your company doesn’t have benefits (health insurance), you can privately insure yourself but it’s expensive. If you have prima facie, you can get Medicare.

Depends on the state you live in. FAFSA and Medicaid most likely. Some give food stamps. Just be careful not to apply for any public benefits that might be looked at negatively for your AOS.
