Good morning Everyone!

 

I filed my vawa case on May 2017 and I'm on second Prima Facie now. My case included 2 restraining orders ( 1 in family court and 1 in criminal court), Police report (were physical injuries were stated), Therapist Report, Letter from the shelter I stayed and pictures of our wedding and many other things that prove the domestic abuse, good faith marriage and other requirements. I feel that with all of this evidence I have a strong case, in God I trust that this will be enough for USCIS. However, I'm a little concern with the processing times. According to the USCIS web site on October 31st 2017 they were reviewing cases from September 12, 2016. WHY ARE THEY TAKING SO LONG??? Before, this was a process that took about 9 months. I check the website almost every day. I'm getting desperate. Are any of you in the same situation? Can you guys share with me how was your process and if you cases got approved or not?  Also, I see many people saying they filed for work permits along with form I-360. My lawyer said this wasn't possible. Any thoughts and comments will be appreciated.

I have not used it at all just kept it on file in case needed, the DMV here requires a SSN and valid status so I had to wait for my ead & ssn.

Same thing for Medicaid (no one asked about prima facie, just SSN & work permit info)

Timeline: 

May 2016 retained an attorney and started to prepare my VAWA petition. 

11/08/2016 mailed my packet

11/28/2016 USCIS rejected my packet (expired forms) :(((  

11/29/2016 Mailed my packet again Via ExpressMail (I-360, I-485, I-864w, I-765, I-912, G-325A) with previous rejection notice on top & a request to expedite EAD

12/14/2016 Date on the NOA  

12/31/2016 Attorney emailed my Prima Facie (Notice date 12/19/2018)   (180 days)

01/14/2017 Mailed my husband’s birth certificate with the blue receipt that came with my Prima Facie

01/17/2018 I-360 online Update (correspondence received)

12/25/2016 Notice for Biometrics

01/12/2017 Biometrics completed

01/31/2017 EAD update (Ordered my new card)

02/04/2017 My first EAD delivered.

02/06/2017 Picked my EAD & applied for SSN

02/14/2017 Applied for state ID

02/15/2017 Applied for Medicaid

06/03/2017 Received my Prima Facie (180 days)

10/22/2017 Mailed EAD Renewal  & AP & Waiver (I-765. I-131, I-912) and request to extend PF

11/21/2017 Received my Prima Facie (60 days)

12/13/2017 Received my New EAD/AP combo card

03/08/2018 Received my Prima Facie (60 days)

05/03/2018 Received my 5th Prima Facie (180 days)

05/08/2018   VAWA approved (online Update)

05/14/2018  Case moved to NBC 

05/15/2018 Approval notice & Deferred Action delivered 

07/26/2018 Mailed EAD Renewal  & AP & Waiver (I-765. I-131, I-912)

09/05/2018 update (ِِAfter responding to the senator's inquiry USCIS stated my file was mailed 08/14/2018 and received by NYC field office 08/23/2018) 

9/22/2018 Received my New EAD/AP combo card

10/24/2018  Attorney emailed my interview notice

11/05/2018 Completed the medical (I-693)

I haven't tried but according to my lawyer in the state of Florida they will accept Prima Facie to demonstrate legal status.

Guys I need an advice: 

I did my medical exam for my coming up interview, and I just found out in December that I’m pregnant. 

The question is: at the TB X-ray they stated that I did the X-ray, and than they wrote that I’m pregnant. 

My concern is, If the Immigration officers ask me why I’m pregnant now, and why not when I was married to my abusive husband.

That should be fine. It is your privacy and decision.

If your spouse is a USC then you can file for adjustment of status and that will allow you file for EAD using category c9, otherwise you file your EAD along with your i-360 under category c31 but the c31 will only be approved after the i-360 approval. USCIS received my case April 2017, I sent a request on Nov 21 to renew my prima facie  that for set to expire dec 15, never heard back till now. 🤔

A few cases filed in middle of 2016 are still pending. You may want to contact your congressman for case assistance, which may tell you what causes the delay.

For EAD, if you have a pending I-485 you can file to get it. Otherwise, you may still file I-765 under C31 but will only be approved after I-360 being approved.

You can file c31 with just the i360 but won’t get approval until your Vawa is approved. If your spouse is a usc you can file i485 and i765 concurrently and get your work permit while you wait on a decision from uscis.

I don't think they update biometric appointment, I did my bio 1month after submission and the website still says "my fees were waived". I guess it will be updated on important issues.

When i did the first one they updated it online....ut would be good if they updated everything

It is taking long because of the number of petitioners. It will take about 14 months (+/-) right now. So you will have to wait until summer time probably to hear back.
