Hi Sandranj,

I would like to give the context of my situation here. We are from India and live in the United States from past 11 years. My husband is on H1 B Visa and his I-140 is approved and I am on dependent Visa H4 EAD. I am married to my husband from past 16 years, we are parents of 2 kids 1 son (14 years) dependent visa and daughter (4 years) US citizen, my husband now and then he physically abuses me and hit me I have all the evidences of abuse. This time I gathered a courage and called 911 and  I denied about his physical abuse when police came to house however police noticed it and came back with 6 more policemen and arrested him and court warned him and released because I did not agreed that he did it. However he threatens me for cancelling my VISA and also my son as well. So I am seeking help and  looking for options whether I am eligible to apply for VISA as per VAWA.

Please advise as your advise will help relieve from anxiety.

If you run away with the kids to a homeless shelter (take you & kids documents)

maybe you can obtain a U visa. by you not reporting the abuse to the cops you

messed up yourself, because they have to sign certification, take pictures of

any bruises and keep a record....Get out of the abuse at least for your kids

Happy holidays everyone! Congratulations who got approved! It is not an easy journey.....

So my vawa timeline is:

12/05/2016 they received my case

12/23/2016 rfe

02/23/2017 respond rfe was received

And my attorney gave me a paper in 08/2017 that extension of prima facie got approved and it's expiring on 03/28/2018 and i need to apply again if they don't make a decision before that date. As he explained it means that I have a strong case.

Just wondering if anyone filed in 12/2016 got approvals? Or how much approximately left to wait?

Not everyone gets prima facie. It's good sign but doesn't guarantee anything  It means on face value you seem like a good candidate for VAWA. They still have to review your application and decide. You can still get denied even if you got prima facie. And if you dont get prima facie it doesnt mean you will not be approved.

@NICOLA2017 so it says: "the request for an extension of a prima facie case for classification on under the self petitioning provisions of the vawa has been reviewed and granted.

This notice can be used to assist you in receiving public benefits.

Is valid for 180 days from notice date shown above(09/29/2017)"
