One of the requirements of U visa is:

The applicant must have been helpful, is being helpful, or is likely to be helpful in the investigation or prosecution of the crime.

The chief officer has to sign form I-918 for applicant first.

Hi Sandranj,

I would like to give the context of my situation here. We are from India and live in the United States from past 11 years. My husband is on H1 B Visa and his I-140 is approved and I am on dependent Visa H4 EAD. I am married to my husband from past 16 years, we are parents of 2 kids 1 son (14 years) dependent visa and daughter (4 years) US citizen, my husband now and then he physically abuses me and hit me I have all the evidences of abuse. This time I gathered a courage and called 911 and  I denied about his physical abuse when police came to house however police noticed it and came back with 6 more policemen and arrested him and court warned him and released because I did not agreed that he did it. However he threatens me for cancelling my VISA and also my son as well. So I am seeking help and  looking for options whether I am eligible to apply for VISA as per VAWA.

Please advise as your advise will help relieve from anxiety.

In order to qualify for VAWA your spouse has to be a US Citizen or Permanent Resident. If he is on H1-B, then you won't qualify for VAWA. You can try for U-Visa, but you can't qualify if you are denying to the police/court that he abused you. U-Visa is for people who are can help to prosecute the crime.

Please seek help. If he is abusing you, go to a domestic violence shelter. At the very least, let someone know - family or friends and so on, so that you have someone to call for help if you decide you want to get out.

I guess those processing times are inaccurate because right now VSC is adjudicating cases for Nov-December 2016(as per what Sandra says), and yet the chart is showing 26 September 2016.

The processing date is as of Oct. 31, 2017 if you read the top line.

As of October 31, 2017 they were adjudicating cases filed at the end of September 2016.

Now that we are almost at the end of December 2017 (2 months ahead of October), they are probably adjudicating cases filed in late November 2016 / early December 2016 (2 months ahead) like Sandra said.

Most of the October cases on this forum are just being adjudicated in December, from the success stories we have had during the past couple of days on this forum. That being said, it is possible to have some cases adjudicated earlier or later.

Nope, that might not be accurate for majority of cases 'cos I filed in mid November and I know a couple of early and mid November cases both on this forum and outside that are yet to be adjudicated.

Each VSC update for the following month shows only 10-14 days progress resulting in a stretched timeline.

Not necessarily, those times were accurate as at October 31st. Since then they could have started on some November & December filers.
