Hello dear Vawa fellows,

 

Can u pls roughly outline what are the next steps now that my vawa (spouse was LPR) is approved?

 

can i apply to SSN, work permit, adjustment of status right away? All together? And how long it takes approximately to get the green card?

Check Visa Bulletin against your priority date on your I-360. You can file I-485 and I-765, I-131 once your priority data is current (meaning there is a visa number for you). If your priority date is not current, file I-765 based on approved I-360, under C31 to get an EAD. Then, use the EAD to apply for SSN and then driver's license.

Not all states issue limited term driver's licenses. For instance, WA, CA can issue 5 year DL based on SSN and EAD as long as EAD is valid. Some states need to check EAD against "SAFE system" before issuing DL. Some states only check SSN.

Thank you so much, I got the general idea of the process. I thought differently before. So, as per my understanding, i look up under the F2A (as a spouse of LPR)? Even if i am divorced now? It says January 2016, so I wait until it says October 2016 under F2A (i filed vawa in October 2016?)

 

i just checked my prima facie, it doesn’t indicate priority date? I mean it’s blank under priority date part? Is my priority date vawa receipt date?

 

sorry, i may sound so stupid, i just dont have any idea about the process, bear with me please))

It was abuse and decree of my first divorce..

update today i went for my infopass of my child who turned 21 and now i have to file for i485 as uscis has given him A no but for renewal of Ead he should have his own AOS pending as   he was on my AOS .. now what gorms should i fill is it I 485, I912 for fee waiver G1145 and 693 for medical... hope it wud work as i  just heard that with EAD renewal automatic 180 days doesn’t work in dmv... God so much of wait for everything...

I remember in this forum, someone discussed about priority date for VAWA petitioners who married LPR. From my memory, your priority date is the VAWA receipt date.

Your priority date is the date your I-360 was received. The priority date is printed on the I-360 receipt, as well as on the I-360 approval notice. I did not mention prima facie.

Yes, you can file I-485, I-765, I-131 when F2A date is 10/2016 or late.

You can file I-765 under C31 with I-360 approval notice now.

VAWA was already approved before this about 2 months ago. All I am waiting for now is I485 interview

Mine was recently approved filed in mid-September. It was approved on the 90th day, I got the approval letter in the mail and the USPS app shows that the card should be delivered tomorrow.

And YES, your visa classification is B21, Family second preferences even after divorce. Look at I-360 approval notice to find these information. Forget about prima facie, which is used for welfare, not for GC.

Can anyone advice im filing for my child i485 its so confusing first what categoru shud i write in category in part 1 as if i write anything part 1 a-1gthen i have to write supplement A then again in part 2 its my self petition so he doesn’t have any petition receipt of his own as he was my derivative first so dont know do i have to put my receipt no or leave ot blank. Then again part it asks whether he had applied for permanent residence so he was on my i130 petition as derivative but as my husband didnt reach but we went there so it was considered abandoned due to my husband absence and denied so do i have to write that he applied with as a derivative or not. In part 4 my son writes his first father name so his first father name wudbe there or his usc father (usc father name is not any his official document) there are so many points vonfusing he was on my petition as derivative but if i am filing separately  i 485  so can anyone help me if they had filed gor their children .. please thx

I found out the hard way that if they issue Prima Facie it will not say so in your online status.  Mine was kept from me for over a year by the attorneys who helped me file my case, so if the address on your petition is going somewhere else make sure it didn't get sent there and no one told you. 

 

There are cases where no prima facie is issued and the case is approved, just like there are cases where prima facie is issued and cases are denied. Sandra had adviced me to send a letter requesting prima facie of you need it, (in my case I had gotten it, but no one told me I had been sent it so now I'm in the process of requesting an extension.)
