We filed K1 and got NOA#1 on June 12th 2017. Yes, they were mentioned in our I129f. Can someone tell me what the exact process is in getting my fiances children home with us. We were planning on bringing her kids home sometime after they finish the school year next year.

Thank you in advance

Need Advice. We are bringing my fiances kids over. But want to wait until there school is done. I know there visa will be good for six months, and if we do follow to join 12 months. Have a couple questions. My fiance estimated arrival is late DEC. to early Jan. and we plan on getting married in Feb.

1) how long does it take to get travel approval after we file AOS? will six months give us enough time?

2) If we do follow to join, do we have to go back to take them to manila for the medical and interview or can the family member they will be staying with until school is out take them?

3) will they really have an interview? they are 5 and 8 years old.

thank you in advance

  1. Typically it's around 4 months for AP to be approved after filing. YMMV...there is never a guarantee. Don't purchase any flights until AP is in hand.
  2. A legal guardian can do so for the medical at SLEC.
    1. http://www.slec.ph/us-visa-applicants.shtml#kvisa
Minors (17 years old and below) must be accompanied by their parent or by a legal guardian who has thorough knowledge of the child's medical history.
The parent or legal guardian must present a government issued ID (original and 2 photocopies)
      1. In case the companion is not the legal guardian, the following documents must be presented:

      2. Letter of Authorization or Special power of attorney stating that the companion is authorized to sign on behalf of the parent
      3. 2 photocopies of the Parent's government issued ID
      4. Authorized companion's government issued ID, original and 2 photocopies
  3. Yes. There will be an interview. Some embassies don't require them for children under a certain age, but it looks like USEM requires it for all applicants.  If both parents are outside of PH then a legal guardian must accompany them.

Q: Do children need to schedule an interview appointment?
A: Every applicant requires an appointment.
Q: Do all children have to come in person for their appointment?
A: Yes. Applicants under the age of 20 must attend their visa interview with at least one parent. If the child is an orphan, or both parents are outside the Philippines, a legal guardian must accompany the child.
