Hi guys,

 

I'm really glad to find this forum so I can ask the questions about my visa application.


Timeline:

    1. My aunt (mother's sister) is US citizen and she filed a I-130 petition (F-4) for my mother as main beneficiary with my father and I as secondary beneficiaries.

    2. Right before we could attend the interview, my mother passed away because of cancer. So NVC sent our case back to USCIS due to the death of main beneficiary.

    3. We filed a 204(l) relief petition to USCIS for me and my father because I'm in US with F-1 student visa which makes us qualified. Then after 6 months, USCIS reaffirmed our case with 204(l) petition and sent it to NVC.

    4. After 6 months, which was yesterday, NVC sent our reaffirmed case back to USCIS.. AGAIN.. for further review.

 

I'm really confused and frustrated for the fact that it will take 6 months at least before we can hear anything from USCIS from now on. And I don't know why NVC has right to return our reaffirmed case to USCIS again. What should I do now?

 

I'm thinking if I can file a I-485 to adjust my status in US instead of going through NVC. Is it OK?

 

Any idea will be gratefully appreciated!!
