Hello, 

My husband is in the process of getting an immigrant visa, we started the process more than 11 weeks ago, they received his DS-260 beginning of June.

On August 11th they asked for a Police Report from France, we sent it to them and they received it on August 22nd. 

I called the NVC today to get a status on our case and the lady told me that it will take up to 11 weeks for them to review the document. Do they really restart the clock every time they ask for additional documents? I feel like it would be a never ending cycle .......

My lawyer says no, they do not restart the clock, but the lady at NVC told me the opposite. 

Any experiences out there?

Yes, they restart the clock but it does not usually take anywhere near 11 weeks.  They simply allow themselves that much time.  Things seem to be speeding up.  You can avoid clock restarts by learning in advance that the police report from France would be required.  Your lawyer should have known that and informed you.  Whether the immigrant lived in additional countries more than six months after their 16th birthday, is one of the questions the lawyer should have asked you.  When you don't live in a certain country anymore, there is no need to wait to get the police report.  You could have gotten it soon after or even before you filed the petition.

 

Looking at your profile, if immigrating FROM France, your lawyer should have informed you the police report was needed.  Did you miss seeing it on the list of required documentation?  It should have gone in with the birth certificate and marriage certificate etc.

She thought that we were supposed to bring it with us to the Embassy, I've had this police report for the past 3 months now, so this is quite frustrating. 

Hopefully this will not take 11 weeks, as we have been waiting for 3 months already.

The problem with most "immigration attorneys" is that the vast majority rarely, if ever, get involved in family based immigration matters.  That's not where the money is.  How would somebody who doesn't already know that ever find out, other than to have a problem like this themselves or read about it someplace like VJ?  Quite the common dilemma.

This requests of NVC are then like an homologue of RFE at USCIS stage...

And they restart the clock! WOW, VJ is a learning center, everyday we get new information...

 This particular applies to my case I've been here since March 2017, so when my process get that stage i will be living here for more than 6 continuous months, and because I've also lived in Cuba I have to provide them both police records, from Cuba and from here from Colombia!

And applies for both countries, Cuba and Colombia!

Excuse me to say this, but in this Journey you can't wonder and think, you should try to be the most secure that you can, make a triple check in every package that you send, and follow the advises that people here gave you! Always is going to be the best advise for you.
