Hi All,

 

I am beneficiary for CR1 in Pakistan we are on NVC stage about to send our Docs but we have find out that we have submit court record which i dont have. I been in UK for 5 years i have police clearance certificate from there. My visa extension was rejected so i file appeal in court. Home office took the case back and started reviewing my case and before home office make any decision i took my case back and came back to Pakistan. Today my wife call NVC and find out that we need to get Court record. My question do we really need to get court record as i never been convicted any crime. Please suggest thank you.

If you never indicated that you were arrested during your stay in UK and you are sure such never occurred, then you don't have to provide a court record or court decision but you will have to provide police report or clearance since having lived there for 5 years. People from UK or people who have lived in UK and back to their home country before applying may tell you what kind of police clearance or report and from where you have to get it if you are not sure about that.  Good luck.

OK, in that case, you don't need a court record but police certificate only.  It could be the NVC rep. who spoke with your wife meant to submit court record if ever been arrested or convicted which is normal.

Be careful with this.  Being "convicted" and being "arrested/charged" are two different things.

USCIS wants to know about any crimes you were arrested for or any crimes you were charged with (even if the charges were dismissed or dropped).  If you have never been arrested or charged with any crime, then you need court records.

Hi i never arrested i just one had a parking ticket which i couldnt pay on time because i changed my address which i paid later to recover agent fully.

will this be including in charge? and if it is i dont know how to get record for it.

I have never read or heard of any one providing court record if "never" been arrested or charged as you have stated. above. You can only provide court record if ever been arrested, charged or convicted, even if the case was acquitted.

so basically appeal in court for visa purpose doesn't count as charge or conviction. if that is the case it means i dont need one. will send my case today hopefully it go through smoothly. Thanks

I made a typo on the second line, sorry.  Meant "ever"...not "never"

No.  

 

My guess is the person at NVC heard the word "court" mentioned (if your wife mentioned about the visa appeal on the phone with them) and automatically jumped to the conclusion of you being arrested/charged with something before without asking for clarification.
