Hi Friends need advice please

 for my brother's situation who is from China.

His family entered to the US as a refuge and  after 6 months he got tourist visa and entered to the US and now he doesn't know how he can apply for green card and stay with his family since his wife still doesn't have Green Card cuz they arrived less than 1 year  maybe in January . they wnt through refuge immigration part and pay to so many attorney none of them gives them good advice.

Once his wife has a green card, she can petition for him by sending in an I-130. The wait is about 2 years from filing to visa (maybe a little longer now, but nobody can say for sure).

 

He can only stay until his I-94 (obtained at POE) expires, so he will need to return home before then. He cannot overstay his visa, work, etc. (just like any other tourist).

Agree, she will need to make enough to sponsor him or have somebody who can joint sponsor.
