Congrats to all the latest approvals! It's so nice to see so many success stories alhumdolillah. Praying that we all are able to share the same good news soon inshAllah!

 

I have another question. After NVC approved my IV package, I received another email stating that something was missing/or incorrect in my Affidavit of Support. It mentioned that my case is already in queue for an interview, and that I need to bring the missing/corrected item to the interview. In the list it just mentioned that I need to bring " a copy of every W-2 form that relates to your 2016 tax returns."  

 

I had not submitted my taxes for 2016 because I was not aware that U.S citizens are required to file their taxes if working abroad. 

 

I ended up submitting my taxes after receiving this letter. 

 

so my question is, do I also need to include all the 2016 W-2 forms for my joint sponsor as well?

 

And I have not filed my 2017 taxes yet because I am having an issue with my School ( I am a teacher in a school). The HR has told me they cannot give me my payslips until I open up a bank account. ( I have been receiving my salary in cash). The bank says I need to submit my taxes before I am able to open up an account. 

 

So what is the deal with tax returns. Is it ok if I dont have 2017 tax returns? 

 

I would greatly appreciate your help as this is making me very very nervous for my husbands interview!!

i honestly don't have much experience with taxes and i'm not sure how many of us here do, so would it be possible for you to consult a US immigration lawyer and see what they think? all i can say is that the CO seemed to care about the affidavit of support and the financial documents quite a bit.

just by going what you've mentioned above, i definitely recommend filing your 2017 taxes - isn't the deadline some time in april? i think there's also an option to submit an extension for filing tax returns - at least if you have that document you may be able to explain why you haven't submitted yours yet. if you're based in UAE, is it possible to use your overseas (US) bank account details to receive your salary?

I forgot to mention another point regarding my 2016 tax returns. My lawyer said I didnt have to file it because my income didn't meet the requirements. So even after submitting my taxes, it amounted to zero. 

 

So basically it was just a formality. I don't owe any money to the IRS and they don't owe me anything. 

 

My salary cannot be transferred to my US bank account. I asked them that. 

I will ask my lawyer about this but hes not too helpful unfortunately. :( 

 

When i received the checklist, he mentioned that my husband just needs to tell the consular that I didn't meet the income requirement for the tax returns. 

 

i appreciate you help wanderlust!

not yet! i will be collecting from empost in abu dhabi based on the selection i made, but i havent been notified yet of when.

Well,,, 

Let me share with you what happen it might be similar to your case in a way or another

Do not take it that that what will happen with you, as it depends on several issues however it just give you a hint of a very similar interview case in the same embassy ...


First we are IR5 which is "petition to parents"... 

Our child was just graduate a year back, so on time of petition we were unable to submit anything however the lawyer asked for an affidavit signed from the child that the child does not work yet and had submitted it along with the original affidavit form that income is 0.
Also submitted  the original affidavit support of the cosponsor ...

The co sponsor did supply the tax for 2015 in that time. 

We received the same note from NVC as you ." that we both need to bring " a copy of every W-2 form that relates to co sponsor 2015 tax returns." plus copy of my Obligatory Military service certificate.

so we did the following: 


1. Getting the tax of 2017 and W2 form of the sponsor.
2. Getting the tax of 2016 and W2 form of the sponsor.
3. Getting the tax of 2015 and W2 form of the sponsor.
4. The tax of 2017 for our child ...
5. Job offer for our child
6. The last Salary slip for our child.
7. the domicile proof

We had too many proofs with us, such as bank account, salary certificates, etc...


The only thing we have been asked for is original Birth Certificate, original marriage certificate.

Then the IO asked if our child is working now we said yes.

Show him the job offer and the last Salary slip.

He looked at the job offer then return it back . he just kept the Salary slip 

He asked me about my work.. my wife work .. then he told me I believe that you had traveled to USA many times . I answered yes that's true 

So he asked did I ever made any trouble there, I said that I have been travelling due to my work and pleasure for many years to Europe, USA, and far east never have any trouble except once I have a speeding fine when my wife was due for labour for our child birth .

He looked at the Affidavit of support mentioned something from our child salary slip then handed us the congratulation notice saying you are both are approved.

A very quick and smooth interview. 

I believe the attorny was arranging every thing on the right order.

The IO did not ask for w2 form.. did not ask to see my original military or any other thing ...

 

We had really 2 huge files none was asked to present.

So this is simply what we did went through ... 

Yesterday was Administrative Proceeding 
Today changed to Issued.

so you might be asked for your w2 form and you might not be asked

why you put your self in this hassle if you already know the rules ?

Go with transparent only and no bags are allowed even ladies ones
