Hello,

My wife came on a K1 Visa and we are currently on her AOS. According to the uscis website we are waiting for her interview to be scheduled. I live in Dallas and want to take a trip this weekend to El Paso driving my car. On the way back from El Paso to Dallas there is a migration check point. What documents does my wife need to present at the check point? Before we just presented her I-94 but it expired already. I would really apreciate your help.

Her foreign passport and AOS NOA1 :) Make sure to bring the marriage certificate too if she's changed her name.

ROC filed on December 1, 2020, assigned to SRC, approved within 106 days on February 18, 2021.

Thank you!!! There shouldn't be a problem right? I called CBP just to make sure and verify what you just said earlier today and the guy who answered was rude and didn't really answer my question he said "If you think you know the answer then why are you calling" and just said to bring her passport but didn't mention anything about NOA1. But since her I-94 is expired i'm a little worried they detain her or don't let her pass.

they won't let her back again, she needs AP or green Card

Just to clarify we will be passing an internal check point inside the USA. She won't be leaving the country. The government has check points 100 miles within the border.

Doesn't matter, getting out is easy, try to get in without legal documents or visa

Sorry for the delayed response. I was out for lunch :) So back to your question at hand, please do not be misinformed. With a pending AOS, the NOA1 shows that she's present legally within the US. That is why I suggested foreign passport + AOS NOA1 + marriage certificate if she has changed her name. Bring copies just in case they want to keep them for their record. Do not let them keep your originals.

 

AP is not needed if she's crossing between US states. Now if she's going between the US and Mexico or US and Canada, then yes, she will need an approved AP.

Although my wife has never been asked for her immigration documents at an internal checkpoint, I always make sure she carries:

  • her passport (still in her maiden name)
  • a copy of her AOS/I-485 NOA1
  • a copy of our marriage certificate

Soon she'll also have her EAD/AP combo card which I hope will reduce or eliminate the need to carry this jumble of paperwork. Although I suppose it's better safe than sorry, especially when dealing with CBP in this day and age!

As this person has said this is all you need for an internally checkpoint here in the USA. My wife and I took a trip during her AOS and we went through a internal checkpoint, we had the documents above and there was NO PROBLEM at all.

This is correct, just do this and you will be fine.
