Hello,

 

Long story long, my USC wife and I started the whole AOS process (from F1) back in March.  Everything seemed to be going well, until we moved to a different state and missed our final interview.  What happened was, we updated our address on July 17 (from MI to IL).  Three days later, we were notified that our interview had been scheduled for August 22, and that an interview notice had been mailed to us.  For some reason, I had a feeling it would be sent to our old address, and that's exactly what happened.  We tried everything; we called USCIS and they were unable to help us, we put in a service request and it was no help.  Finally we were able to make an Infopass appointment at our local office in IL on the date of our interview.  When we showed up to our Infopass appointment in Chicago (with no interview notice), we were told that our interview had been schedule at the Detroit office, and that USCIS would reschedule an interview for us.  A week has gone by and we finally got a letter in the mail from USCIS, but it was our old interview notice for our missed interview.  

 

Below is a timeline of events:

 

July 17 – Moved to Chicago, IL and updated our address on the USCIS website

July 20 – Received an online notification from USCIS that our interview had been schedule for August 22, and that an interview notice had been mailed

July 27 – Received a letter from USCIS at our new address (CHICAGO) notifying us that USCIS updated our address in their system

August 1 – We put in a service request on the USCIS website regarding our interview notice, as we still had not yet received it and were afraid that the letter had been sent to our old address

August 9 – Received a letter at our updated address (CHICAGO) regarding the status of our service request, and we were told to follow instructions in the notice (which we still had not received)

August 19 – Called USCIS and asked representative what we should do as we still had not received an interview notice, and were told to go to our local USCIS office and inquire about it

August 22 – Day of Interview – We went to local office, immigration officer informed us that our interview was scheduled at the Detroit office, and that we would receive a new interview notice to reschedule

August 28 – Received a letter for our interview in the Detroit office scheduled for August 22. No further information regarding a reschedule

 

Wondering if anyone has been in a similar situation before? If so, how did you go about it? What should I do next? I am afraid our application will be denied because we didn't show up to our interview, even thought it was their fault and we have proof from USCIS that we updated our address before they sent the interview notice.

 

Any insight is appreciated!

You probably need another infopass or to wait for the new letter to arrive. You basically went there last week.

I did do that right after I moved.  The letter was still returned to USCIS according to their website.

The only thing you can probably do at this point is make another infopass appointment and tell them they mixed up the address again---bring in proof that USCIS received your change of address in July, and the August interview letter showing the incorrect office in Detroit.

Thanks for the reply.  I just made another infopass appointment for next week so we'll see what happens...

Thankfully I already have my EAD as I will be starting my job next week. The frustrating part is that I won't be able to attend the infopass appointment, so my wife is the only one who will be there to speak with the officer.. I'm hoping this won't be an issue.

Give her power of attorney specifically to discuss USCIS matters on your behalf. You're the petitioner for AOS so they may say they can't talk to her.
