Hey everyone! 

 

I hope you are well. 

 

I have a few questions regarding the joint sponsor. I and my husband recently submitted our aos and iv packages to the NVC (SD: 9th Aug). When we submitted it I read online that for a household of 2 the minimum required income is $20,000ish. We wrote his income and my income in the required spaces which came to $30,000 however it was him that earns $10,000 and me the remaining $20,000. I'm worried because he is a student so he's only working part time to earn that much and as we lived in japan his last 3 years of IRS transcripts are basically $0 - $1000 dollars and don't reflect that he was earning way over $30,000 a year in japan. 

 

Although we wrote a cover letter stating his Japanese earnings and also submitted earnings in assets (our car, apartment, savings etc.)  I'm concerned that they will only be concerned with how much HE earns on the i864 ($10,000) and his lack of earnings on the 2014-2016 transcripts. 

 

I don't want us to get a checklist asking for a joint sponsor. To be safe - should we just submit a joint sponsor form before that happens? 

 

We definitely have a few people that could support me as a joint sponsor with way over the requirement. I'm just wondering how they will view our case and what is best to do. (Aka: freaking out about not getting a checklist when we are so close to the finish line lol)

who is he filing for?

 

because if it's you, your income doesn't count unless you will have the same job in the US, you will be transferred from your company and have your same salary

 

if not, and he is petitioning for you, your income doesn't count. do you have more than one car, more than one apartment and how much savings does he have?

he is petitioning for me. I won't be transferred from my company I will be looking for a job once I arrive. 

 

Thats what I thought. We just share one car and will live in our apartment together. He showed a savings account with around $18,000.

it won't be enough, he will surely get an RFE, you can't send anything now until he gets the RFE, which will give him time to get a joint sponsor

 

for assets you have to have more than one car and house or apartment, since immigration needs to be able to liquidate his assets within a year if you become a public charge and the government decided to get the money back

 

and the savings account has to be 3 times the difference, so he should need, over 30K in savings

Why cant we submit the joint sponsor application now before receiving the checklist? 

 

It doesn't make sense to have more than one car or apartment when we are living together.. but yea I can understand that he may not have enough so we should submit the joint sponsor.

 

what would happen if we just sent the joint sponsor application now?

because immigration can't leave him without a means of transportation or place to live in

 

a lot of people in the US have more than one car, they can't take away the only car he has or leave him in the streets if he has only one house

 

you will need to wait for the nvc to send you a letter and you will need to send the joint sponsor's affidavit and documents with the letter

 

if you send it now it will get lost and not matched with your case

What do you mean leave him without a car or place to live? Those things are his. 

I'm not quite sure what you mean by that.

 

but anyway - I have heard of other people being able to send things in that they forgot / or realized is required before a checklist! If I clearly state the case number etc will it not reach my case? That seems like a waste of time to wait! 

I don't want it to restart the eleven weeks..

They will let you use assets as collateral only if they can seize and liquidate those assets.

They will not seize a person's only home or vehicle, so those don't count.

I've never read or heard anything about them seizing anything. I thought you just wrote your assets to prove you have enough money? Where did you read that?

The whole point of a sponsor is that this person is financially responsible for you and can reimburse the US government if you are a burden to them. How does the government get reimbursed if there's no money and no assets to liquidate?

There's no need to be angry at me. I'm simply trying to understand the situation and didn't realize they would be thinking to seize the assets. I just thought it was to know about earnings. Anyway my first question has been answered so I'll be sending a joint sponsor petition to add to my case.

I'm glad you got your answers. as stated the whole point of the petitioner and primary sponsor to have enough income or assets is in case you become a public charge for the government, if you were to become a public charge, they could sue your husband to get their money back,

 

if your husband had no money and only assets, the government needs to be able to liquidate those assets within a year to get its money back

 

if you read the instructions of the i864 it will explain the part about assets

we both have money. He has about 18,000 in savings and i have around 10,000 dollars as well. But I saw on the form if they look from the money side you need 125% over the federal rate so... we would need like 150,000 or something?! 

 

So crazy. This is driving me insane trying to find a sponsor when both of us are fine financially!! :(

You are very confused! Take a deep breath and slow down. Its a stressful process! :)

You look at the poverty guidelines. For a household of 2 you are correct its around 20k. (I dont have the forms infront of me to post the correct amount sorry) But lets pretend the number is 20k exactly. You need to show CURRENT income of 20k between the 2 of you. The income also has to be continuing. So any money you earn overseas that will stop when you get the US wont count. If your income is 20 and his income is 10 and his is the only income that is continuing then you have 10 in income. You need to have 20. So you take the difference (20-10=10) which leaves you 10k short. You can make that up in assets as long as the assets (for a spouse petition) are 3X the amount. So 10X3=30. You would need to have 30 k in cash, stocks, home equity, etc. Hope this helps.

 

Also you can send in the joint sponsor forms now if you want. They may not get attached to your file though. When ever you send something unsolicited theres a chance it wont get attached to your case and will be lost. So send it now if you want to try to get a head start but keep copies incase they dont get attached and are requested from you in the future.

You are right! It is super confusing. I feel like I have no breath to take or time to waste so sorry if my messages come across as intense.

 

Thank you for the break down and information around assets. It is helpful to me.

 

I wanted to send a joint sponsor form now but a lot of people have warned about them being lost and also some people said there is a chance they will just ask for it to be brought to interview. So perhaps its best to wait...

 

Have to find a sponsor first as well. 

 

Looks like I can probably expect a 3+ month delay ahead. :(
