Yes but they still want to know for N400 too. For example we just had combo interview. ROC was approved and husband got new GC a week later. A couple days later he got RFE for N400 for more relationship evidence because the IO didn't take any of the relationship evidence he brought with.

Because you were applying based on the 3 year marriage eligibility not 5 years ad LPR

I discussed earlier on here withdrawing our N400 and reapplying for 5 year when the time came to avoid having the burden of producing relationship evidence. Others here on VJ told me it doesn't matter that they still ask for evidence and will ask questions about the relationship because thats how the GC was obtained. One of uscis' jobs is to make sure the GC was not obtained through fraud. Yes you are eligible even being divorced but you still must demonstrate the marriage was entered in good faith and not just to get a GC. What I am telling you is based on what others here on VJ told me. I can't tell you exactly what they will ask for during a 5 year citizenship interview.

I agree.. That's why I submitted ALL the possible documentation I can find :) - will take those with me, just in case. I came here on H1B and my extensions were very much intrusive.. so I'm used to it.. thanks.

Typically they are only going to ask for additional information if they believe there is a reason to request, i.e. something is fishy and doesn't add up.

 

I remember you guys and some issues with your initial case and getting it together, so extra evidence is probably wise for you. We submitted NO evidence for our CR1 and not all that much for our ROC, so I think we are in a different place.

 

Regardless, we didn't submit that extra evidence and I doubt it will be requested as standardly for a 5 year, the previous divorce decrees and marriage certificate is part of the deal. There is the validity of the marriage for the GC right there.  The fact that we are still married 7 years later, have a couple of kids, and live in the middle of nowhere MN together is about all the proof anyone needs.  😂 Plus, everyone from the fire chief, to the sheriff, to our elected politicians has seen us together a lot. We kind of stand out.  I'm sure we could just get by on witness statements if we needed to from most of our town.

We had initial problems with k1 visa for a medical reason that was resolved with a doctor's letter. AOS was smooth, hardly submitted anything, and was approved with no interview. ROC was approved after combo interview in which I was sitting in the lobby and the IO didn't even invite me in. Our lawyer said we are the easiest cleanest case he has and that it's just bad luck that the IO didn't take our relationship evidence at interview when we brought everything. If he would have taken the evidence I can guarantee we wouldn't have got a RFE. IOs are humans too, who can make mistakes. So the next person the case was handed to that IO was probably thinking "where is the evidence??" So that same evidence was resubmitted through the website in response to RFE.

 

I kind of wished the IO would have interviewed me I would have insisted him to take the our whole binder.

If the IO who conducted our interview was suspicious of us surely I would have been brought in to be interviewed. My husband told the IO I was out there. The IO even said to my husband "its very obvious you guys are legitimate I have no concerns".

 

Maybe he was so convinced we were legitimate that was the reason he didn't take any evidence besides my passport biographical page and our marriage certificate.

Had my interview today.

 

Arrived about 25 mins early - went through security quickly and checked in.  The guy at check-in was a bit confused as his computer said I was already a citizen, which made me a little less nervous.  I'm thinking they might pre-approve, pending the interview.

 

I was only seated for about 30 seconds when they called me.  There was quite a bit of noise in the room at the time, and I couldn't understand the number, but when I asked those around me, they couldn't hear it properly either, but they yelled it from the door.

 

USCIS interviewer was nice. She asked me to verify my details, asked a few questions from the application (name of my husband, whether we have kids, do I belong to a terrorist organization), and asked about any international travel since my application.  I hadn't submitted my 2017 tax return when I applied in 2018, so I had transcripts from both 2018 and 2017, but she wasn't interested.  I had actually worked many nights to get my small business paperwork completed so we could get our taxes in for the interview.  We had received the interview letter whilst traveling, so we had less time than usual to prepare.

 

I had to do a reading test (What was the first state?) and a writing test (Delaware was the first state), and the civics questions:

 

What is the economic system of the United States (capitalism)

Who is the Vice President? (I nearly said Joe Biden!)

Name one war the US participated in during the 1900's (World War 2)

Name one branch of government (executive)

Who is in charge of the executive (the president)

Name one thing the federal government can do (print money)

 

She then said she was recommending me for approval and my oath would be in about a month.

 

I tried to update the spreadsheet but the link I had says the file is in the trash, so FWIW, I first applied 4/29/18, so my interview was a year to the very day of my application.

Another note - my case status online says that I was recommended for approval and I'm in line for an oath ceremony - but also my file is going to have a "quality review" - so probably a new agent and they are randomly double checking some of the work.

Yes a different IO will conduct the final review than the one who interviewed you.

Congratulations! Regarding quality review, go to your uscis.dhs.gov account. You might already have the notifications 'you attended your interview' and 'we approved your applic.' If so, I'm assuming from personal experience that you're in line for oath. I couldn't get rid of that under qual review until i got oath ceremony notification 46 days after interview.

Yes, I'm in line for the oath - the online account is also where I saw the "quality review" notice as well as being in line for the oath.  Just hoping the quality review doesn't decide they want my tax transcripts, given I would have been happy to hand them over today.  It's easy enough to upload, I'm just ready for this whole thing to be done.

I was 5-yr based. Tax transcripts weren't asked. Don't worry too much. You'll get your oath letter soon!

Depends on the IO doing the review. We got a fussy IO and got a RFE even though we were recommended for approval. Did you submit regular tax returns instead of transcripts? Or no tax returns at all?

I had the tax transcripts of my returns downloaded from the IRS site.  When I applied in '18, I supplied them for tax years 2016 and prior (as I hadn't submitted 2017).  

 

I downloaded 2017 & 2018 for the interview to demonstrate that we didn't owe the government any money (we have been due refunds every year).  I have the PDF if they need it.
